AMENDMENT No . 2
TO CITY SECRETARY CONTRACT
`VHEREAS, the City of Fort Worth (CITY) and Dunaway
Associates, L.P. , (ENGINEER) made and entered into City
Secretary Contract No. 40923, (CONTRACT) which was authorized
by M&C C-24491 on the 28th day of September, 2010 in the
amount of $263, 800 . 00 .
WHEREAS, the contract was subsequently revised by
amendment No. l in the amount of $10, 000 administratively
authorized on September 6, 2013;
WHEREAS, the CONTRACT involves engineering services for
the following project:
Water Main and Sanitary Sewer Relocations along State
Highway 114 to Martin Ranch Road F.M. ; and
WHEREAS, it has become necessary to execute Amendment
No. 2 to the CONTRACT to include an increased scope of work
and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
February 2 , 2016, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional
design services to be performed by Engineer totals
$351, 163 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that

shall be an amount of $624, 963 . 00 .

Interstate Highway 35 West Water and Sanitary Sewer Relocation
City Project No. 01515
Dear Mr. Sauceda:
Dunaway Associates, L.P. is pleased to present this Amendment No. 2 for the following
additional services that are beyond our original scope of services.
TxDOT has decided to expand the State ROW in the area around Interstate Highway 35 West
from State Highway 114 to Eagle Parkway to construct continuous frontage roads. Relocation
of the City utilities in the same area will be required to occur prior to TxDOT's road construction.
Dunaway proposes to provide additional survey, geotechnical borings, easement preparation,
and construction pian design to address TxDOT's design changes as with the nearby State
Highway 114 Part 1 project(DOE No. 6465). As part of this effort, Dunaway will also prepare
and submit TxDOT utility reimbursement package to cover the City's design and construction
costs.
SCOPE OF WORK
1. Field Topographic Survey for an additional 5,200 LF of Water Main & 1,500 LF
of Sanitary Sewer parallel to and crossing Interstate Highway 35 West.
2. Geotechnical borings for 6 locations for proposed By Other Than Open Cut
installations on both sides of Interstate Highway 35 West.
3. Preparation of Ten (10) additional Permanent Easements.
4. Design of an additional additional 5,200 LF of Water Main & 1,500 LF of
Sanitary Sewer parallel to and crossing Interstate Highway 35 West.
5. Preparation of TxDOT utility reimbursement package.

Dunaway proposes to provide the above described scope of work for a LUMP SUM fee of
$361,163.
Only those services specifically mentioned in the Scope of Work section are offered as a part
of this proposal.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinances increasing estimated receipts and appropriations in
the Water Capital Projects Fund in the amount of$381,544.00 and Sewer Capital Projects Fund in
the amount of$138,619.00 for a total amount of$520,163.00; and
2. Authorize execution of Amendment No. 2 to City Secretary Contract No. 40923 with Dunaway
Associates, L.P., in the Amount of$351,163.00 for a revised amount of$624,963.00 for the Water
Main and Sanitary Sewer Relocations along F.M. 156 from State Highway 114 to Martin Ranch Road
project.
DISCUSSION:
On September 28, 2010 (M&C C-24491), the City Council authorized an Engineering Agreement with
Dunaway Associates, L.P., in the amount of$263,800.00 for the Water Main and Sanitary Sewer
Relocations along F.M. 156 from State Highway 114 to Martin Ranch Road project. The Agreement
was subsequently revised by one amendment in the amount of$10,000.00 which was
administratively authorized on September 10, 2013.
Amendment No. 2 will provide for the following:
• Design of existing water and sewer relocations to facilitate the widening of State Highway 114 at the
IH-35W intersection by the Texas Department of Transportation. The existing 24-inch water and
18-inch sanitary sewer mains are in direct conflict with the proposed highway improvements.
• Additional coordination with Oncor Electric, Texas Department of Transportation and Franchise
Utilities.
• Additional easement preparation.
• Additional service during construction.
• Additional geotechnical investigations.
• Additional subsurface utility engineering.
• Additional traffic control plans.
Dunaway Associates, L.P., proposes to provide the necessary additional services for a lump sum fee
of $351,163.00. Staff considers the fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, $169,000.00 (water: $109,000.00; and sewer: $60,000.00) is
required for program management, real property acquisitions, material testing and
inspection. Appropriations for the Water Main and Sanitary Sewer Relocations along F.M. 156 from

M/WBE OFFICE - Dunaway Associates, L.P., is in compliance with the City's M/WBE Ordinance by
committing to an additional 20 percent M/WBE participation on this Amendment No. 2. The City's
goal on this amendment is 12 percent.
This project is located in COUNCIL DISTRICT 2, Mapsco 642 L and 642Q.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of
the attached appropriation ordinances, funds will be available in the current capital budget as
appropriated, of the Water Capital Projects Fund and the Sewer Capital Projects Fund. The Fiscal
Year 2016 Water Operating Budget includes appropriations of$26,068,353.00 for the purpose of
providing pay-as-you-go funding for capital projects. After this transfer for Fiscal Year 2016, the
balance will be $14,913,647.00. The Fiscal Year 2016 Sewer Operating Budget includes
appropriations of $26,300,046.00 for the purpose of providing pay-as-you-go funding for capital
projects. After this transfer for Fiscal Year 2016, the balance will be $20,820,373.00.
