COUNTY OF TARRANT WHEREAS, The City of Fort Worth ("City") and Komatsu/Rangel, Inc. d/b/a Komatsu Architecture ("Architect") made and entered in City Secretary Contract No. 43365 (the "Agreement"), in the amount of $353,441.00, including up to $7,821.25 in reimbursable expenses, which was duly authorized by Mayor & Council approval by M&C C-25624 on the 5th day of June, 2012; and WHEREAS, on the 7th day of June, 2013, Amendment No. 1 to the Agreement was administratively executed to provide for additional design services in the amount of $21,597.25 to modify plans and to expand the scope of work; and WHEREAS, further amendment is necessary for additional engineering services in the amount of $3,500.00 with no reimbursable expenses, to include additional services to perform an "as-built" survey for an installed sanitary sewer line and the street curb and gutter; and WHEREAS, further amendment is also necessary to clarify the language and attachments that constitute the Agreement; NOW THEREFORE, City and Architect, collectively referred to as (the "Parties"), acting by and through their duly authorized representatives, enter into the agreement: 1. Section I, Services of the Architect, Paragraph 1.1 of the Agreement is hereby amended to read in its entirety as follows: 1.1 The City hereby contracts with Architect as an independent contractor, and the Architect hereby agrees to perform, within the professional standards normally accepted in the State of Texas, professional services in connection with the following general scope of work: Provide design, construction documents, and construction administration services for the design of a new Community Facility which will incorporate an existing building to be renovated as part of these services. This new Community Facility will be located between Evans and New York and between Dashwood and Humbolt streets in Fort Worth, Texas ("Project"). The scope of services include the Basic Services and Additional Services of topographic survey, plat, programming and reimbursable expenses; and is described more fully in Attachment"A" of this Agreement. Provide design services to include Additional Services to modify plans and to expand the original proposal's scope of work. The cost of this Additional Service is $21,597.25. The Additional Services are described more fully in the Komatsu letter dated May 29, 2013 (rev) subject: Additional Services, New Bethlehem United Community Center, Fort Worth, which is attached hereto as Attachment"B" and made a part of this Agreement. Provide design services to include Additional Services to confirm the "as-built" installation aspects of a sanitary sewer line and the curb and gutter along East Humbolt Street and East Dashwood Street. The Total Cost of this Additional Service is $3,500.00 with no reimbursable expenses. The Additional Services are described more fully in the Komatsu letter dated December 11, 2015, subject: Additional Services, New Evans Rosedale Community Center, Fort Worth, Texas which include Exhibit"A" and Exhibit"B", which are attached hereto as Attachment"C" and made a part of this Agreement. The total compensation for all of the assignments to be performed by Architect pursuant to this Agreement shall be a fixed fee of$378,538.25, including up to$7,821.25 in reimbursable expenses. 3. The document that is attached to the Agreement as Attachment "A" is hereby amended to read in its entirety as set forth in Attachment"A" to this Amendment No. 2 to the Agreement. 4. The Agreement is hereby amended to add Attachment"B"which shall read in its entirety as set forth in Attachment "B"to this Amendment No. 2 to the Agreement. 5. The Agreement is hereby amended to add Attachment "C" which shall read in its entirety as set forth in Attachment"C" to this Amendment No. 2 to the Agreement. 6.
