THIS SECOND AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 43353.
as amended, ("Second Amendment') is made and entered into by and between the City of Fort Worth.
Texas, a home-rule municipal corporation of the State of Texas ("City"), acting by and through its duly
authorized Assistant City Manager, and the 2tennis.net. LLC, a Texas limited liability company
("Contractor"), acting by and through its duly authorized representative.
WHEREAS, the City owns certain dedicated parkland known as Rosemont Park. located at 1400
West Seminary Drive, Fort Worth, Texas 76115 ("Park"),
WHEREAS, a portion of the Park has been set aside for the operation of a municipal tennis
facility known as the McLeland Tennis Center, which is located at 1600 West Seminary Drive, Fort
Worth, Texas 76115 ("Center"),
WHEREAS, on or about June 29, 2012, the City and the Contractor entered into an agreement
for the Contractor to manage the Center, the same being City Secretary Contract("CSC")Number 43353;
WHEREAS, the initial term of the Agreement was for three (3) calendar years, which expired on
June 30, 2015. and included two successive two year renewal periods,
WHEREAS, the parties amended the Agreement to revise the renewal option to just one
successive one year renewal term, which expires on June 30, 2016. said agreement being CSC Number
43353-AIR1 (CSC Numbers 43353 and 43353-AIRI are collectively, referred to herein as the
"Agreement'");
WHEREAS, the parties desire to amend the term of this Agreement to add two months, with the
term to expire on August 31, 2016:
NOW, THEREFORE, in consideration of Ten Dollars and No Cent ($10.00) to be paid to the
City by the Contractor, the sufficiency of which is hereby acknowledged, the City and Contractor agree to
amend the Agreement as follows:
AMENDMENT
1. The parties agree that, notwithstanding anything in the Agreement to the contrary, the
current renewal term of the Agreement set to expire on .lune 30, 2016 shall expire on August 31, 2016.
2. All terms of this Second Amendment that are capitalized but not defined shall have the
meanings assigned to them in the Agreement.
3. All terms and conditions of the Agreement that are not expressly amended pursuant to the
Second Amendment shall remain in full force and effect.
