A0 ala APPROVAL FOR DISPOSITION OF PROPOSED SURPLUS RIGHT OF WAY CONCURRING IN THE STATE'S DETERMINATION THAT A PORTION OF THE STATE'S RIGHT-OF-WAY IS NO LONGER NEEDED FOR THE USE OF CITIZENS AS A ROAD AND THAT THE RIGHT-OF-WAY BE QUITCLARvIED IN ACCORDANCE WITH STATE REGULATIONS. WHEREAS, the State of Texas acquired and holds in its name right-of-way on S.H. 183 (old Loop 217) and Spur 465 as described in Exhibit A attached hereto and made a part hereof, and WHEREAS, the State of Texas has determined that said right-of-way is no longer needed for the construction, maintenance and operation of S.H. 183 and Spur 465, and WHEREAS, City Staff have studied the public need for said right-of-way and have determined that said right-of-way is no longer needed for the use of citizens as a road or for public transportation purposes, and is not suitable for conservation, park, recreation and/or similar purposes. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. That the portion of the State's right-of-way, within the city limits of the City of Fort Worth, shown on the attached Exhibit A is no longer needed for the use of citizens as a road and is not suitable for conservation, park, public transportation, recreation or similar purposes; 2. That the City of Fort Worth concurs in the State's plan to dispose of the right-of-way in accordance with the established laws and regulations of the State of Texas. DISCUSSION: The state has requested that the City evaluate its need for a tract of state-owned right-of-way which lies at the southwest corner of the intersection of State Highway 183 (Southwest Boulevard) at Spur 465 (Bryant Irvin Road). This tract includes a portion of Legend Road which was closed by the City of Fort Worth. The state has required that the median crossover for Legend Road onto Bryant Irvin Road be closed. The City has received a letter of commitment from the developer, West Bryant Irvin Partners, L.P., agreeing to pay for the cost of closing the median as part of a Community Facilities Agreement. City staff has studied the public need for said right-of-way and has determined that said right-of-way is no longer needed for the use of citizens as a road or for public transportation purposes, and is not suitable for conservation, park, recreation and/or similar purposes due to size, location, and topography. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
