WHEREAS, on July 16, 2013, the City of Fort Worth("City") and TARRANT PAINT
& STAIN, LLC, a Texas limited liability company ("Contractor") made and entered into City
Secretary Contract No. 44736 (the "Contract") for the Cowtown Brush-Up ("CTBU") Program
services as approved by the City Council on July 16, 2013 in M&C C-26332.
WHEREAS, the Contract provided payment to Contractor for exterior
painting/preparation, priming of painted surfaces, and carpentry services to prepare houses that
will be painted as part of the City's Cowtown Brush-Up Program.
WHEREAS, the Contract was for a 1 year term beginning August 21, 2013 through
August 20, 2014 and provided for 4 additional 1 year terms;
WHEREAS, the Parties agreed to extend the Contract for an additional 1 year term
beginning August 21, 2014 through August 20, 2015 in the First Amendment;
WHEREAS, the Parties agreed to extend the Contract for an additional 1 year term
beginning August 21, 2015 through August 20, 2016 in the Second Amendment;
WHEREAS, the Parties have agreed to extend the Contract for an additional 1 year term
beginning August 21, 2016 through August 20, 2017; and,
WHEREAS, it is the mutual desire of City and Contractor to amend the Contract to meet
Contract objectives.
NOW, THEREFORE, City and Contractor hereby agree to amend the Contract as
follows:
I.
The first sentence of ARTICLE 5. TERM OF CONTRACT is amended to be and
read as follows:
"This Contract shall commence as of the Effective Date and shall automatically expire
upon the earlier of the expenditure of$300,000.00 or August 20, 2017 (the "Expiration
Date"), if not terminated sooner or extended as described below."

II.
All other terms and conditions of City Secretary Contract No. 44736 not amended herein
remain unaffected and in full force and effect, are binding upon the Parties, and are hereby
ratified by the Parties. Capitalized terms not defined herein shall have the meanings assigned to
them in the Contract
