(No M&C Needed) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and Ned K. Burleson & Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 23140, (the Contract) which was authorized by the City Council by M&C -C-16211 on the 12th day of August 1997; and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the { following project: Engineering contract for the design of Main 004 Drainage Area Sanitary Sewer System Evaluation and Improvements (Group 7, Contract 2) . WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated December 19, 2000, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $1,197.15 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $249567 . 91 FEUDED °)y U iso V�'•,Irt_i�Jtlp t 3. Worth, TX 76102 Dear Mr. Rakesh Chaubey: This memo is to clarify the reasons why the original re-plumbing of service for Lots 11 A& 12A Block 123 of the Original City of fort Worth was unsuccessful. Based upon the landowner and City policy, as expressed by the City Staff, the original design was directed toward minimizing parking obstruction to the business on the subject property. This excluded designing a service across the existing parking lot to the proposed manhole 2+53 M4-B in Cummings street, which had a gravel surface at the time of design. Here are additional reasons to the original design: • Pre-Design and Pre-Construction could not televise L-1904 to locate the functioning service line for the structure on subject property. • A manhole only labeled as MH 6 near the center of Block 123 could not be located by City services,television inspection, or our firm. • A uniform slope was interpolated from the 2 known manholes on L-1904 being 515 feet apart. Combined with the distance, missing manhole and inability to televise L-1904 a true slope and depth for the existing service could not be known until construction began. • Due to a 24"water main being out of position as reported on City of Fort Worth as-built sheets, the original designed was compromised. The new manhole invert position,in the intersection of Bluff and Pecan streets is at least a foot higher than designed. • The service route to manhole 27+64 in Pecan Street could have been achieved with a 1% slope on the 4" service and lowering the manhole invert to 609.78 resulting in a 0.5%slope to the new manhole position in the intersection of Bluff St. and Pecan St. Based upon these facts, it is our contention that the change in design was the result of changes in data that was not available at the time of original design. We therefore request and additional amendment to increase the contract amount by$1,197.15 to provide for additional services. Ned K. Burleson, Ph.D., P.E. President �-— Ned K.
