HomeMy WebLinkAboutContract 26548 SUPPLEMENTAL AGREEMENT NO. 1 STATE OF TEXAS g CITY SECRETARY CONTRACT NO. �65 Vd COUNTY OF TARRANT g WHEREAS, the City of Fort Worth (City) and Carter & Burgess, Inc., (Engineer) made and entered into City Secretary Contract No. 22521 , (the Contract) which was authorized by the City Council by M&C C-15852 on January 9, 1999; and WHEREAS, the Contract involves engineering services for the following project: Design and Prepare Construction Plans for Intersection Improvements to relieve traffic congestion at Beach Street and IH-820; WHEREAS, it has become necessary to execute this Supplemental Agreement No. 1 to said Contract to include an increased scope of work and revised lump sum fee; NOW, THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement that amends the Contract: 1. Section 2 of Article I of the Contract is amended to include the additional engineering services specified in M&C C18373, adopted by the City Council o December 5, 2000, and further described in Attachment A, copies of which are bot attached hereto and incorporated herein. The cost to City for the additional services to performed by Engineer total $53,000. 2. Article III, Paragraph A of the Contract is amended to provide for an increase in the lump sum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$357,500. 3. FOR INTERSECTION IMPROVEMENTS ON NORTH BEACH STREET AT IH-820 PROJECT NO. 30-021209 RECOMMENDATION: I It is recommended that the City Council authorize the City Manager to execute Supplemental Agreement No. 1 to the Engineering Services Agreement with Carter & Burgess, Inc. to provide additional design services for intersection improvements on North Beach Street at IH-820 for a lump sum fee of$53,000. p: DISCUSSION: On May 9, 1995 (M&C C-14800), the City Council authorized the execution of a Congestion Mitigation and Air Quality Improvement Agreement with the Texas Department of Transportation (TxDOT) for intersection improvements on North Beach Street and IH-820 at an estimated cost of $3,200,000. Under this agreement, the state is responsible for 53% of the funding for design, right-of-way acquisition and construction of the project, and the City is responsible for funding the remaining 47% of the overall cost. On January 9, 1997 (M&C C-15852), the City Council authorized the execution of an engineering services contract with Carter & Burgess, Inc. to prepare the plans and specifications for intersection improvements on North Beach Street at IH-820 at a cost of$304,500. During the design review process, TxDOT required that the scope of the project be expanded to include frontage roads, Texas Turnaround and traffic signals. Staff negotiated a fee of $53,000 for the additional design and believes that this amount is fair and reasonable. This project is located in COUNCIL DISTRICT 4. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Street Improvements Fund.
