AGREEMENT FOR THE INSTALLATION OF CROSSING SURFACES
ON SCHWARTZ
WHEREAS, it would be advantageous to both Fort Worth and Western Railroad user of
Dallas Area Rapid Transit (DART) tracks and the City of Fort Worth to replace the
existing crossing surface at Schwartz Avenue; and
WHEREAS, the City of Fort Worth has agreed to participate in the cost of construction
of this crossing surface to the extent provided herein;
NOW THEREFORE, the City of Fort Worth, Texas, a municipal corporation acting by
and through Mike Groomer, its duly authorized Assistant City Manager, hereinafter
called "CITY", and Fort Worth and Western Railroad, acting by and through Robert
Roberson, its duly authorized Chief Executive Officer, hereinafter called "RAILROAD",
agree as follows:
1. The Railroad will replace and widen the existing Schwartz Avenue crossing
surface to a 63 foot crossing using Omni precast concrete crossing material or an
approved equal.
2. The Railroad will provide, or cause to be provided, all material, labor, equipment,
supplies, and incidentals necessary to complete this work. The work shall be
completed within ninety (90) calendar days from the date of execution of this
Agreement.
3. The Railroad will fiiniish such watchmen and flaggers as may be necessary for

the safety of Railway property and the operation of trains during the construction
of the project.
4. The City's participation for the above work shall be for the installation of 63 track
foot surface crossing using Omni precast concrete crossing material for a total
cost not to exceed 5,24,785.62. This lump sum cash payment will be forwarded to
the Railroad within thirty (30) days of satisfactory completion of the replacement
and widening of the railroad crossing.
5. The Railroad will provide all necessary traffic control for this project.
