TO CITY SECRETARY CONTRACT
VVHEREAS, the City of Fort Worth (CITY) and Kimley-Horn
and Associates, Inc. , (ENGINEER) made and entered into City
Secretary Contract No. 45872 , (the CONTRACT) which was
authorized by M&C C-26873 on the 22nd day of July, 2014 in the
amount of $208, 150 . 00; and
FVREREAJS, the CONTRACT involves engineering services for
the following project:
Bellaire Drive South and Arborlawn Drive Sanitary Sewer
Main Replacements; and
VVItEREAS, it has become necessary to execute Amendment
No . 1 to the CONTRACT to include an increased scope of work and
revised fee.
NOWTREREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:
1 .
Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
June 8, 2016, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional
design services to be performed by Engineer totals
$120 , 649 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be
an amount of $328,799 . 00
3 .
All other provisions of the Contract, which are not
expressly amended herein, shall remain in full force and
effect.

Dear John:
This letter is in reference to a contract between Kimley-Horn and Associates, Inc. (Kimley-Horn)and
the City of Fort Worth (the City) dated 08-21-2014 referred to herein as the"Contract.
Due to discussions related to the project, the original scope of the sanitary sewer project has changed.
During discussions with City Staff, it was decided that due to multiple proposed developments within
thesanitary sewer basin, design and construction of the recommended Wastewater Master Plan
improvements in this corridor was necessary. Since these improvements were not included in the
original contract, the following services will be performed as Amendment No. 1:
ITEM 1 — MAS_IER PLAN EVALUATION: $10;580Kimley-Horn

These services involve analyzing the City's Sanitary Sewer MasterPlan through the Bellaire Drive
South corridor including:
• Evaluation of existing corridor constraints
• Analyzing future flow conditions
• Providing cost projections for various alignment alternatives
• Attending review meetings with City staff
• Providing design recommendations regarding the proposed sanitary sewer line configurations
through the Bellaire Drive South Corridor

Kimley-Horn will design additional sanitary sewer line segments within the Bellaire Drive South
corridor including:
• Conceptual Design, feasibility analysis and preparation of opinion of probable construction
cost for two (2) alignments for 1,750 linear feet of parallel 48-inch sanitary sewer
• Re-Design and Upsizing from previously identified 42-inch sanitary sewer to 60-inch sanitary
sewer for approximately 2,650 linear feet
• Eight(8) sanitary sewer laterals within the Bellaire Dr. ROW
• Two (2)additional sanitary sewer junction structures

We recommend that the City increase the budget by$120;649 for these additional services. The

RECOMMENDATION:
It is recommended that the City Council amend Mayor and Council Communication C-27839 to
correct the contract amendment amount to $120,649.00 and the revised contract amount to
$328,799.00 for Amendment No. 1 to an Engineering Agreement with Kimley-Horn and Associates,
Inc., for Bellaire Drive South and Arborlawn Drive Sanitary Sewer Main Replacements, City Secretary
Contract No. 45872.
DISCUSSION:
On August 2, 2016, Mayor and Council Communication (M&C C-27839) City Council authorized
Amendment No. 1 in the amount of$120,649.00 to City Secretary Contract No. 45872, an
Engineering Agreement in the original amount of$208,150.00 with Kimley- Horn and Associates,
Inc., for Bellaire Drive South and Arborlawn Drive Sanitary Sewer Main Replacements. In that M&C,
the original contract amount was inadvertently listed as $218,150.00 and the revised contract amount
was inadvertently listed as $339,299.00 instead of$328,799.00
This M&C rectifies the error. All other content of M&C C-27839 remains in full force and effect.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funding for this change order exists as outlined in the original
Mayor and Council Communication.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of$121,149.00 from available funds; and
2. Authorize the execution of Amendment No. 1 to City Secretary Contract No. 45872 an Engineering
Agreement with Kimley-Horn and Associates, Inc. in the amount of$120,649.00 for Bellaire Drive South
and Arborlawn Drive Sanitary Sewer Main Replacements for a revised contract amount of$339,299.00.
DISCUSSION:
On July 22, 2014 (M&C C-26873), the City Council authorized an Engineering Agreement with Kimley-
Horn and Associates, Inc., in the amount of$218,150.00 for Bellaire Drive South and Arborlawn Drive
Sanitary Sewer Main Replacements.
Amendment No. 1 will provide for the following:
• Design for two additional sanitary sewer junction structures for flow control and eight sanitary sewer
laterals within the Bellaire Drive South right-of-way.
• Design recommendations including rehabilitation of the existing 36-inch and 42-inch sanitary sewer and
replacement of the existing 42-inch sanitary sewer with 60-inch sanitary sewer.
• Cost projections for the various alignment alternatives.
•Analysis of the future flow projections from the Wastewater Master Plan.
• Construction phase services including additional shop drawing review and record drawing preparation.
In addition to the amendment amount, $500.00 is required for project advertisement.
This project will have no impact on the Water Department's operating budget.
M/WBE OFFICE: Kimley-Horn and Associates Inc., is in compliance with the City's BDE Ordinance by

committing to an additional 12 percent on this Amendment No. 1.
The project is located in COUNCIL DISTRICT 3, Mapsco 89A.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Sewer Capital Projects Fund. The Fiscal Year 2016 Sewer Operating Budget includes appropriations
of$26,300,046.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects. After
this transfer for Fiscal Year 2016, the balance will be $12,037,000.00.
