O. ` AMENDMENT No. 1 INTERLOCAL COOPERATION AGREEMENT FOR RECONSTRUCTION AND ASPHALT OVERLAY OF SILVER CREEK ROAD FROM THE FORT WORTH CITY LIMITS TO THE SILVER CREEK BRIDGE WHEREAS, The CITY and COUNTY entered into that certain Interlocal Agreement, (City Secretary No. 48064, CO#123064), ("Agreement") for the purpose of reconstructing and improving Silver Creek Road from the Fort Worth city limits to the Silver Creek Bridge ; and WHEREAS, CITY and COUNTY (collectively, the "Parties") desire to amend the Agreement in order to accomplish the additional construction goals of the Parties ("Amendment"); and WHEREAS, during reconstruction of Silver Creek Road, an additional 1,300 linear feet of Silver Creek Road was identified as needing repair,which COUNTY performed; and WHEREAS, CITY desires to reimburse COUNTY its apportioned cost pursuant to the original agreement's terms; and WHEREAS, CITY has reviewed the scope, costs, and schedule for the additional work and finds them to be fair and reasonable; NOW, THEREFORE, for and in consideration of the above recitals and the covenants and conditions contained herein, CITY and COUNTY do hereby agree as follows: A. COUNTY has adequately furnished materials, labor and equipment for the reconstruction and asphalt overlay of the additional linear footage of Silver Creek Road. B. CITY hereby agrees to reimburse COUNTY the amount of$45,440.23, which is the cost of materials purchased by COUNTY for the additional linear footage of Silver Creek Road as shown on Exhibit"A"attached hereto. C. All other terms and conditions, general or specific, not amended hereby remain unaffected and in force. In accordance with Texas Government Code § 791.014, Tarrant County hereby gives its specific written approval and acknowledgment of the completed Project described below. The Project information is as follows.- PROJECT ollows:PROJECT and LOCATION: Approval of Amendment No. 1 to the Interlocal Agreement between Tarrant County and the City of Fort Worth for the Reconstruction and Asphalt Overlay of Silver Creek Road from the Fort Worth City Limits to the Silver Creek Bridge, said Project being within the municipal limits of the City of Fort Worth and Tarrant County Commissioner Precinct # 4. The local governments that have requested the Project and with whom the Interlocal Agreement is by and between are Tarrant County, Texas, and the City of Fort Worth, Texas. By vote on the date below, the Tarrant County Commissioners Court has approved the Project identified above and authorized execution of this document by the presiding officer of the Tarrant County Commissioners Court.
