HomeMy WebLinkAboutContract 26639 AMENDMENT TO CITY SECRETARY CITY SECRETARY CONTRACT N0. 25559 CONTRACT NO. os�Cs CE STATE OF TEXAS § COUNTY OF TARRANT § THIS Agreement is made and entered into by and between the City of Fort Worth ("City"), acting by and through Libby Watson, its duly authorized Assistant City Manager, and the Far Greater Northside Historical Neighborhood Association ("FGNHNA' or "Contractor"), by and through JD Jiimmerson III, its duly authorized Executive Director. Contractor's business address is 2950 Roosevelt Avenue,Fort Worth, Texas 76106. WHEREAS, the City and FGNHNA have entered into a contract identified as City Secretary Contract No. 25559 for a period beginning January 24, 1999 and ending January 23, 2000; and WHEREAS, it is the mutual desire of the parties to renew said City Secretary Contract No. 25559. NOW, THEREFORE, THIS AGREEMENT FURTHER WITNESSETH: That, the parties covenant and agree as follows: 1.2. Duration of Contract Section 1.2 "Duration of Contract" of City Secretary Contract No. 25559, currently on file in the office of the City Secretary of Fort Worth is hereby amended to read as follows: 1.2.1. This contract is extended for six (6) months beginning on the date of execution of the contract amendment. 3.2. Buu et Section 3.2 "Budget" of City Secretary Contract No. 25559, currently on file in the office of the City Secretary of Fort Worth is hereby amended to read as follows: 3.2.1. Contractor agrees that the HOME funds will be expended in accordance with EXHIBIT "B". No change shall be made without prior written approval of the City. Under no circumstances shall the total amount of program funds expended by Contractor from funds paid by the City exceed Seven Thousand Seven Hundred Seventy Five Dollars and Seventy Two Cents($7,775.72). 3.6. Cost Principles Section 3.2 "Cost Principles" of City Secretary Contract No. 25559, currently on file in the office of the City Secretary of Fort Worth is hereby amended to read as follows: 3.6.2. All non-federal entities that expend $300,000 or mored 1 funds within �UI�IJ MPS( 1 one year, regardless of the source of the Federal award, must submit to City an annual audit prepared in accordance with 24 CFR Sections § 570.502-570.503 generally, with specific reference to OMB Circulars (with attachments) A-122 and A-133 as appropriate. The audit may cover either Contractor's fiscal year during which this contract is in force or cover the period of this contract. The audit must be prepared by an independent certified public accountant, be completed within twelve (12) months following the end of the period being audited and be submitted to City within thirty (30) days of its completion. Contractor's audit schedule is attached hereto as EXHIBIT "E" - AUDIT SCHEDULE. Costs of preparation of this audit may be an allowable expenditure of HOME funds in an amount proportional to that of the HOME funds used in contractor's total agency operating budget. Non-federal entities that expend less than $300,000 a year in federal funds are exempt from Federal audit requirements for that year, but records must be available for review or audit by appropriate officials of the Federal Agency, pass-through entity (City), and General Accounting Office (GAO). Unless specifically amended herein, all the other terms and conditions of Contract No. 25559 shall remain unchanged and in full force and effect. Authorize the City Manager to renew City Secretary Contract No. 25559 with the Far Greater Northside Historical Neighborhood Association (FGNHNA); and 2. Authorize the contract performance period to begin on the date of contract execution and end six months thereafter; and 3. Authorize the City Manager to extend or renew the contract if the FGNHNA requests an extension or renewal, not to exceed $7,775.72; and 4. Authorize the City Manager to amend the contract, if necessary, to achieve project goals provided that the amendment is within the scope of the project and is in compliance with applicable laws and regulations. DISCUSSION: 19 The FGNHNA is the lead agency in implementing housing and economic development projects in the Far Greater Northside Model Blocks. It is also a Community Housing Development Organization (CHDO) certified by the Housing Department to cant' out housing development projects in the greater northside area. On October 26, 1999 (M&C C-17714), the City Council awarded the FGNHNA CHDO operating funds in the amount of $30,000.00. The City signed a contract with the FGNHNA on January 24, 2000, (City Secretary Contract No. 25559) on the use of the funds. The performance goal of the contract is the completion of an infill housing development project evidenced by site control of vacant lots in the Far Greater Northside area. City Secretary Contract No. 25559 expired on January 23, 2001, with a balance of $7,775.72. The FGNHNA has requested renewal of the contract in order to complete their development proposal. Because of the improved image of the neighborhood, the price of private properties has increased and private builders are competing for developable properties in the Far Greater Northside area. The FGNHNA intends to acquire properties from the Fort Worth Housing Finance Corporation's land banking program. The Far Greater Northside Model Blocks is located in COUNCIL DISTRICT 2. The Safety and Community Development Committee approved this recommendation at its February 13, 2001 meeting.
