HomeMy WebLinkAboutContract 26653 AMENDMENT NO.-3 CITY SECRETARY CONTRACT No. STATE OF TEXAS $ CITY SECRETARY CONTRACT NO. y (No M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Wendy Lopez and Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 24775, (the Contract) which was authorized by the City Council by M&C 17350 on the 30th day of March 1999; and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Main 21 Drainage Area Sanitary Sewer System Evaluation and Improvements (Group 7, Contract 3) , Part 3. WHEREAS, it was necessary to amend City of Fort Worth City Secretary contract 24775 on two occasions to provide for an increased scope of work, as well as increasd compensation for such work, such amendments being City of Fort Worth Secretary Contracts Nos. 25355 and 26418; and WHEREAS, City Secretary Contract No. 25355 (Amendment 1) increased the scope of work, as well as increased the original contract amount by $24,000.00; and WHEREAS, City Secretary Contract No. 25556 (Amendment 2) increased the scope of work, as well as increased the original contract amount by $6,441.41; and WHEREAS, City Secretary Contract No. 26418 incorrectly states that the total_ fee to be paid by the City of Fort Worth shall not exceed $ 96,279.33 and is also incorrectiv titled Amendment 2 NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated November 6, 2000, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $2,646.56 2. Article II of the Contract is amended to provide for an increase in the -2- �� @ �� IY�!'ry;�1ir'�jfi 0 A maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $102,720.70 3. (WLA)is pleased to complete our engineering design obligations under Sanitary Sewer Project PS46-070460460310 and Amendments No.l, No. 2 and No. 3. This letter will serve as a request for Amendment No. 3 to our agreement for fees associated with additional engineering services for the subject project. During the construction phase of this project, conflicts were discovered between existing utilities and the proposed sanitary sewer lines'horizontal and vertical alignments. WLA was directed by the City of Fort Worth(COFW)to revise design sheets, attend site meetings,and author confirmation letters to resolve the alignment conflicts. WLA provided these services and submitted an itemized letter of additional engineering services and fees as directed by COFW. However, on September 22, 2000, Wendy Lopez and Associates, Inc. and the City of Fort Worth agreed that WLA would invoice the City half the additional engineering service fees associated with the realignment of the sanitary sewer lines.
