(No M&C Needed) COUNTY OF TARR.ANT S WHEREAS, the City of Fort Worth (City) and RJN Group, Inc. , (Engineer) made and entered into City Secretary Contract No. 24775, (the Contract) which was authorized by the City Council by M&C C-14834 on the 30th day of May 1995; and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Main 219 Drainage Area Sanitary Sewer System Evaluation and Improvements (Group 7, Contract 3) , Part 3. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 7, 2001, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $5, 000. 00 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $511,297.00. Engineering and Information Technology Services An Employee-Owned Firm March 7, 2001 Mr. Rakesh Chaubey, Project Manager Fort Worth Wet Weather Program City of Fort Worth 811 Lamar, Suite 310 Fort Worth, TX 76102 RE: Contract Amendment No. 3 M-219 Drainage Area Sanitary Sewer System Rehabilitation and Improvements Project No. PS58-070460410090, D.O.E. 2556 Dear Mr. Chaubey: The following is a summary of additional work requested for Amendment No. 3 to the M-219, Part 7, Unit 3 Sewer Replacement Contract, per recent design meetings with City of Fort Worth officials. Also enclosed is a copy of the original signed agreement and copies of previous amendments to the contract, as you requested during our telephone conversation yesterday. The contract amounts shown on the documents are as summarized on RJN's latest payment invoice from RJN to the City of Fort Worth on the M-219 project, dated July 2, 1999. The proposed amendment includes additional survey and design work to replace a deficient sewer main with a new 8" diameter sewer main. The proposed sewer line is located upstream of Main 143, which was replaced as part of Amendment No. 2 to the M-219 Drainage Area Sewer Replacement Project. The cost summary also includes dye tests performed by RJN earlier this week to verify whether additional businesses are tied into the sewer system to be replaced, as requested by City officials. The existing sewer lines are located within existing 6' wide and 20' wide City of Fort Worth Sanitary Sewer easements. An exhibit showing the scope of improvements is attached as Exhibit No. 1. The sewer line is located within the Weiner Clothing Store Parking lot on Ephirham Ave. (Highway 183), and extends on the East side to a lot across Azle Avenue, serving the Salvation Army outlet store. We will need to obtain at least one Right-of-Entry to provide additional area for equipment and storage of materials at the Weiner Clothing Store. We propose to utilize Gorrondona & Associates, Inc. (G & A) to perform the field surveying. If Gorrondona is unavailable given the short notice to do the work, RJN will perform the field surveys in-house. The total cost to perform the additional services included in Contract Amendment No. 3 is as follows: Rgp/acement of Sewer Latera/5930, 2013& Main 143"A" See Exhibit 1); M-143'A', Sta 0+29 to Sta 1+90 = 161 L.F. Ph, Serv, $5,000 The current status of the contract between RJN Group, Inc. and the City of Fort Worth for the M-219 Drainage Area Sanitary Sewer System Rehabilitation & Improvements Project (city Contract #21143) is as follows: Original Contract Amount Including Basic, Optional &Additional Services = $ 383,087.00 Amendment No. 1 Amount = 94,790.00 Amendment No. 2 Amount = 28,420.00 Amendment No. 3 Amount = 5,000.00 Total Contract Amount Including Amendment No. 3 = $ 511,297.00 Please process Amendment No. 3, to the M-219 Drainage Area Rehabilitation Contract in the amount of $5,000. Because of the status and nature of the sanitary sewer deficiencies with the existing sewer line, RJN began work on the field surveying and plan/profile sheets after we received written authorization from the City of Fort Worth on February 14.
