STATE OF TEXAS § COUNTY OF TARRANT § SECOND RENEWAL OF FORT WORTH CITY SECRETARY CONTRACT NO. 46063 This SECOND RENEWAL OF FORT WORTH CITY SECRETARY CONTRACT NO. 46063 ("Renewal") is made and entered into by and between the City of Fort Worth, a home-rule municipal corporation of the State of Texas ("City"), acting herein by and through its duly authorized Assistant City Manager, and Lawrence Collins ("Consultant"), an individual. The City and Consultant are individually referred to as a "parry" and collectively referred to as the "parties." WHEREAS, City and Consultant are currently parties to a contract for consulting services, the same being Fort Worth City Secretary Contract No. 46063 (the"Agreement"); and WHEREAS, the Agreement provides for an one-year Initial Term with options for up to four, one-year Renewal Terms; and WHEREAS, the parties wish to renew the Agreement under the same terms and conditions for a second Renewal Term, commencing October 1, 2016. NOW, THEREFORE, the City of Fort Worth and Consultant do mutually covenant and agree as follows: 1. CODE: C TYPE: CONSENT PUBLIC NO HEARING: SUBJECT: Authorize Execution of a Professional Services Agreement with Lawrence Collins in the Amount of$65,000.00 for Consultation and Representation on State Issues Before the Texas State Legislature, State Agencies, State Boards and Commissions and the Office of the Governor (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council authorize execution of a contract with Lawrence Collins in the amount of$65,000.00 for professional services involving consultation and representation of the City of Fort Worth before the Texas State Legislature, state agencies, state boards and commissions, and the Office of the Governor. DISCUSSION: The City of Fort Worth (City) retains outside legislative consulting services in order to maintain resident expertise regarding the City's relationship with the State Legislature. The role of an outside consultant is to assist the City in promoting and protecting its legislative interests in Austin, Texas. Lawrence Collins worked with our state legislators, legislative staff, and state agencies to seek funding requests and appropriations as directed by the Mayor and City Council and City Management. In each of the last five state legislative sessions, Mr. Collins executed a lobbying and advocacy strategy to assist in securing a $3.1 million state appropriation, a large portion of which was used to finance construction and renovation costs at the Fort Worth Business Assistance Center and fund its business assistance programs. In addition, Mr. Collins assisted the City in preparing and communicating the request for certification of each $3.1 million appropriation to the State Comptroller, and worked to resolve legal and constitutional concerns raised by the State Comptroller's office regarding the form of the appropriation legislation. During the 2013 Legislative session, Mr. Collins executed a lobbying and advocacy strategy that helped to secure a $10 million appropriation for Housing Retention and Supportive Services for the Homeless, a portion of which will be used to finance programs and services under the City of Fort Worth's Directions Home Plan. Mr. Collins was also instrumental in the passage of the appropriation rider and legislation that established $25 million to fund programs to address Mental Services for the Homeless. Due to the advocacy efforts of Mr. Collins, $25 million of state funds were appropriated to fund programs in the top five cities in Texas. The City of Fort Worth and the Tarrant County Region will receive $5 million to address mental health issues associated with the homeless. In addition, Mr. Collins was key in lobbying and advocacy efforts to restore approximately $15 million in funding for local parks that had been eliminated in previous legislative sessions. As needed during the legislative session, Mr. Collins provided advice and counsel regarding state agencies and commissions that interface with the City and promoted working relationships and goodwill between the City, key staff, and board members of various state agencies and commissions, when requested by the City. The proposed Agreement requires Mr. Collins to provide advice and counsel regarding state agencies and commissions as well as provide assistance in promoting passage of legislative initiatives for the City during legislative sessions and the interim session. The proposed Agreement requires the City to compensate Mr. Collins at a rate of$5,333.33 per month. The City shall reimburse Mr. Collins for expenses incurred when he is requested to travel to Fort Worth by City Council or Staff. The approved reimbursable expenses shall not exceed $1,000.00 for the term of the Agreement. Term; Renewal Options-The term of the Agreement will be from October 1, 2014 to September 30, 2015. This Agreement may be renewed for up to four additional one-year terms at the City's option. This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term. The terms are subject to re-negotiation upon mutual consent of both parties at the time of such renewal.
