North Central Texas Council Of Governments July 18, 2016 Mr. Fernando Costa, FAICP Assistant City Manager City of Fort Worth 1000 Throckmorton Street Fort Worth, TX 76102 Dear Mr. Costa: The Regional Transportation Council (RTC) awarded $3,207,650 ($2,566,120 of Regional Toll Revenue funds and $641,530 of local match) of funding to the City of Fort Worth for the Summer Creek Station TOD Sustainable Development infrastructure project. This project was funded through the 2009-2010 Sustainable Development Call for Projects. On November 20, 2014, the North Central Texas Council of Governments (NCTCOG) and the City of Fort Worth executed an agreement for this project. On July 6, 2016, NCTCOG staff received notice from the developer of the proposed land development component of the project that they were no longer interested in pursuing the grant for this project. The City of Fort Worth has communicated their agreement with the cancellation of this project. Because of this request, NCTCOG and the City of Fort Worth have agreed to formally end the Summer Creek Station TOD Sustainable Development project. The awarded Regional Toll Revenue funds of$2,566,120 will be reprogrammed. Please sign and date this letter to confirm the cancellation of this project. NORTH, TX City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 9/20/2016 DATE: Tuesday, September 20, 2016 REFERENCE NO.: G-18826 LOG NAME: 06SUMMERCREEKSTATIONTOD2010SUSTDEVCANCELLATION SUBJECT: Authorize Cancellation of a $3,207,650.00 Regional Transportation Council Funding Award and Funding Agreement for the Summer Creek Station Transit Oriented Development Sustainable Development Infrastructure Project at Sycamore School Road and Summer Creek Drive (COUNCIL DISTRICT 6) RECOMMENDATION: It is recommended that the City Council authorize the cancellation of a $3,207,650.00 Regional Transportation Council funding award and funding agreement for the Summer Creek Station Transit Oriented Development Sustainable Development Infrastructure Project at Sycamore School Road and Summer Creek Drive at the request of the private development partner. DISCUSSION: On September 15, 2009, (M&C G-16700) City Council authorized the Planning and Development Department to submit nominations for three infrastructure projects for funding through the North Central Texas Council of Governments (NCTCOG) Sustainable Development Program. The Regional Transportation Council (RTC) subsequently approved reimbursement grant funding for the Summer Creek Station Transit Oriented Development (TOD) Sustainable Development Infrastructure Project in the amount of$2,566,120.00, which was to be matched by $641,530.00 in local funds for a total project award of$3,207,650.00. The funding was intended to design and construct pedestrian amenities including wide sidewalks, street trees, pedestrian lighting, and bulb-outs, as well as bike trails, landscaping, a new public street connecting Sycamore School Road to Summer Creek Drive, and widening of Sycamore School Road between Chisholm Trail Parkway and The T's future bus transfer and passenger rail station. The reimbursement grant required a 20 percent local match, which was to be provided by the project proponent and local development partner (Legacy Capital/Summer Sycamore 1) in conjunction with a qualifying mixed-use vertical development project. On July 15, 2014, (M&C G-18252) City Council adopted Resolution No. 4329-07-2014 authorizing the execution of a Funding Agreement with NCTCOG and the Texas Department of Transportation (TxDOT) for the Summer Creek Station TOD Sustainable Development Infrastructure Project. In addition, the City Council adopted Appropriation Ordinance No. 21313-07-2014 for$3,207,650.00 and authorized the execution of a Development Agreement with Legacy Capital/Summer Sycamore I for the required mixed- use vertical construction component of the Summer Creek Station TOD Sustainable Development Infrastructure Project. On November 20, 2014, a Funding Agreement was executed (CSC No. 46345) between the City of Fort Worth, NCTCOG, and TxDOT for the project. A Development Agreement was drafted but never executed for the project. No grant funds have been received or expended. On July 6, 2016, the private development partner on the project, Legacy Capital Company, sent a letter to NCTCOG requesting that the project be cancelled due to the developer's difficulty in assembling the required local match funds, including funds from adjacent property owners. Based on the above circumstances, Staff recommends that the City Council authorize the cancellation of the $3,207,650.00 Regional Transportation Council funding award and the executed funding Agreement for the Summer Creek Station TOD Sustainable Development Infrastructure Project. NCTCOG will reprogram the $2,566,120.00 grant award to another project. The required local developer match of$641,530.00 will not be paid. This project is located in COUNCIL DISTRICT 6. This M&C does not request approval of a contract with a business entity.
