Notice of Establishment of a Quiet Zone under 49 CFR 222.39(b)(1) and under Appendix B to Part 222 (1). This letter and the attachments are a Notice of Establishment (NOE) for the creation of a quiet zone under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1). As required by the Federal Railroad Administration under 49CFR 222.43, the following information is provided to you and other parties. EFFECTIVE DATE OF QUIET ZONE -222.43(d)(1)(i) Routine use of the locomotive horn at the crossings listed below shall cease effective November 22, 2016. LIST OF HIGHWAY RAIL-GRADE CROSSINGS within the QUIET ZONE—222.43(d)(2)(i) The Notice of Intent (NOI) included a fourth crossing, PVT-Verizon, DOT# 795 358S. However, the attached FRA Approval Letter excludes this crossing in the quiet zone approval. Therefore, this NOE references only the three crossings approved by the FRA. All public and private highway-rail grade crossings to be included within the proposed quiet zone are: Crossinq ID Street Name Location on Street Improvements 795 356D Wall Price Keller Rd 5800 Block Channelization -ASM 795 357K Kroger Drive 5900 Block Channelization—ASM 795 375H Innovation Way- Private Channelization The City of Fort Worth plans to implement a quiet zone at these crossings with the improvements described for each crossing below. Wall Price Keller Road —Alternate Safety Measure (ASM) Wall Price Keller Road is an existing two-lane highway crossing equipped with flashing lights and gates, constant warning circuitry, and power-out indicators. The existing traffic signal is interconnected with the railroad equipment and provides advance preemption. The agency installed channelization at this crossing that is 100 feet in length to the west of the crossing and 37 feet in length to the east of the crossing. Although channelization has been installed at this location, they do not comply with the length requirements to be considered as a Supplemental Safety Measure (SSM). The channelization on the east of the crossing is less than 60 feet in length due to a commercial driveway on the south side of the roadway. Although channelization has been installed at this location, they do not comply with the length requirements to be considered as a Supplemental Safety Measure (SSM). The channelization to the east of the crossing is less than 60 feet in length due to intersection of Kroger Drive and US Highway 377. As a result, this modified SSM has been treated as an ASM in establishment of the quiet zone. Innovation Way- Private Drive This private drive is the entrance for the Options Clearing Corporation (OCC), formerly Corning Optical Communications, and is an existing two lanes wide private access equipped with flashing lights and gates, constant warning circuitry and power-out indicators. The private crossing owner has installed channelization on both approaches. REGULATORY BASIS FOR QUIET ZONE ESTABLISHMENT—222.43(d)(2)(ii) This quiet zone is being established under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1). The City of Fort Worth applied for approval of the quiet zone using modified SSMs that do not fully comply with the requirements for an SSM under Appendix A of the train horn rule and are therefore considered an ASM. The Public Authority Application (PAA) was submitted to the Federal Railroad Administration (FRA) and all railroads operating over the public grade crossings within the proposed quiet zone, the State agency responsible for grade crossing safety, and the State agency responsible for highway and road safety on May 12, 2015. The agency received the FRA approval letter on October 14, 2016. (Attachment E) FRA NOTICE OF APPROVAL—222.43(d)(2)(ii)(B) This quiet zone is being established under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1) and a copy of the FRA approval letter dated October 14, 2016 is provided in Attachment E. DIAGNOSTIC TEAM REVIEW-222.43(d)(2)(iii) A diagnostic team review is not required for this quiet zone under 222.39(b) or 222.27. However, the agency did invite State agency representatives, all affected railroads and the FRA to attend a diagnostic team review that was conducted on August 5, 2010. TIME PERIOD FOR HORN RESTRICTION -222.43(d)(2)(iv) The quiet zone shall restrict the routine sounding of locomotive horns 24 hours a day. EXISTING GRADE CROSSING INVENTORY FORMS -222.43(d)(2)(v) An accurate and complete grade crossing inventory form for each public, private, and pedestrian grade crossing within the quiet zone that reflects conditions existing at the crossings before quiet zone improvements were made are provided in Attachment C. QUIET ZONE GRADE CROSSING INVENTORY FORMS -222.43(d)(2)(vi) An accurate and complete grade crossing inventory form for each public, private, and pedestrian grade crossing within the quiet zone that reflects ASMs in place upon establishment of the quiet zone are provided in Attachment D. NOTICE OF INTENT—222.43(d)(2)(vii) A Notice of Intent to Establish a New Quiet Zone at the above listed location was sent, by certified mail — return receipt requested, to all railroads operating over the public grade crossings within the proposed quiet zone, the State agency responsible for grade crossing safety, and the State agency responsible for highway and road safety on February 19, 2013. In its application, the city suggested effectiveness rates for its proposed alternative safety measures (ASM) at the Wall Price Keller Road and Kroger Drive grade crossings as follows: • The ASM at the Wall Price Keller Road crossing(Milepost(MP) 741.33) will consist of 100 feet of channelization to the west of the crossing, and 37 feet of channelization to the east of the crossing. The city suggested an effectiveness rate of 0.60; this is consistent with the information provided. • The ASM at the Kroger Drive crossing (MP 741.68)will consist of 100 feet of channelization to the west of the crossing, and 44 feet of channelization to the east of the crossing. The city suggested an effectiveness rate of 0.65;this is consistent with the information provided. There are also two private grade crossings, Innovation Way and PVT-Verizon, located at MP 741.94 and MP 742.15,respectively. In an email dated July 28, 2015, the city asserted that the Innovation Way private grade crossing—which is equipped with flashing lights and gates, constant warning time circuitry, and power-out indicators—is located one-quarter mile(plus 26 feet) from the Kroger Drive public highway-rail grade crossing. Because the Innovation Way private grade crossing is located nearly one-quarter mile from the Kroger Drive public grade crossing, the city may include the Innovation Way private grade crossing within its proposed New Quiet Zone if the private crossing is treated in accordance with the recommendations of the diagnostic team. 2 However, the PVT-Verizon private highway-rail grade crossing is located approximately 0.47 mile from the Kroger Drive public crossing and approximately 0.75 mile from the North Tarrant Parkway public crossing(which is located within an existing quiet zone). Accordingly, the city may not include the PVT-Verizon private highway-rail grade crossing in its proposed New Quiet Zone because this private crossing is located too far from the public quiet zone crossings on either side of it.I FRA recognizes that the PVT-Verizon private crossing, which provides access to a cell phone tower, is subject to limited vehicle use. As reflected in the diagnostic team meeting notes in the city's application,the PVT-Verizon private crossing is equipped with locked gates on both roadway approaches to the crossing, which appear to be opened once a month to allow for cell phone tower maintenance. Therefore, FRA encourages the city to work with railroads that operate through this private crossing to re-evaluate current horn sounding practices and determine the appropriate level of horn sounding at this location. With the exception of the PVT-Verizon private highway-rail grade crossing, FRA approves the city's application. FRA has determined that implementation of the proposed ASMs, as described in the city's application, will result in a Quiet Zone Risk Index of 19,549. This index is below the risk index with horns (the risk that would be present if the horns were still sounding) of 52,874. The city may submit its Notice of Quiet Zone Establishment consistent with 49 CFR § 222.43, What notices and other information are required to create or continue a quiet zone? and the terms of FRA's approval as set forth above, after the city implements the proposed ASMs described in the application and complies with all applicable quiet zone requirements in §§ 49 CFR 222.25, How does this rule affect private highway-rail grade crossings?, 222.27, How does this rule affectpedestrian grade crossings?, and 222.35, What are the minimum requirements for quiet zones? In addition, 49 CFR § 222.39(b)(1)(vi)requires the city to provide a commitment to implement the safety improvements it proposed in the public authority application. Thus, FRA's approval is also conditioned upon implementation of the safety improvements described in the city's application. 'It has been FRA's longstanding position that public authorities can include private highway-rail grade crossings within a quiet zone that are located within one-quarter mile of the quiet zone's outermost public highway-rail grade crossings.
