HomeMy WebLinkAboutContract 47353-A1 AMENDMENT NO. 1 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES COMMUNITY CENTERS EXPANSION PROJECT (Handley-Meadowbrook Community Center Expansion) STATE OF TEXAS CITY SECRETARY CONTRACT NO. 3241 COUNTY OF TARRANT WHEREAS, The City of Fort Worth ("City") and GSBS Batenhorst, Inc. ("Architect") made and entered into City Secretary Contract No. 47353 (the Contract) which was authorized by the City Council by M&C C-27564, the 15th day of December, 2015, for Eugene McCray Community Center Expansion & Hand ley-Meadowbrook Community Center Expansion; and WHEREAS, further amendment is necessary to reimburse the Architect as part of the design services agreement for additional design services for the Integrated Stormwater Management (iSWM) Program requirement in relationship with the platting of the property. NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, (6) — Scope of Services, a paragraph shall be added to read as follows: Provide additional design services for the design and detailing of performing iSWM for the park site and building site in support of the platting process. The cost of this additional service is $6,600.00 with no additional reimbursable expenses. The scope of services is described more fully in GSBS's letter, Attachment "C" dated August 12, 2016 (Revised 9/2/16, 10/3/16), subject: "Re: Handley/Meadowbrook Recreation Center". 2. Article II, (1) — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "C". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "C". However the total fee paid by the City shall not exceed a total of $6,600.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." 3. Bidding: The Architect has no responsibility in the bidding or negotiation phase of the Work. Contract Administration: No Change to original contract except see below for projects not running concurrently. Consultants: No Change to original contract. Owner's Consultants: No Change to original contract. Cost of the Work: Appropriate costs associated with Scope of Work changes as noted above. Compensation: We propose to complete the Scope of Work Changes to the Handley/Meadowbrook Recreation Center described above for a stipulated sum for Basic Services of $6600.00 If additional services are required by the Owner the Architect will provide a written proposal for approval and authorization in writing by the Owner to proceed with such work. Reimbursable Expenses: No Change to original contract. Design Schedule: As mutually agreed by all parties. However, both projects were accounted to run concurrently thus saving the Owner Construction Administration fees. If the projects are no longer running concurrently during the CA Phase, Owner agrees to revisit this item for appropriate compensation to perform the Work. Scope includes the analysis of existing site conditions, including Data Collection and evaluation of existing drainage infrastructure. Preliminary and/or Final iSWM acceptance may require the design of on-site controls (e.g. Detention) or off-site improvements to the public infrastructure. Design of on-site and off-site drainage improvements to be covered under separate scope. Basic scope includes analysis at the low point of the property or the storm sewer system immediately adjacent to the property at where the drainage from the property enters the storm sewer. A downstream assessment is not included as a basic service unless specifically referenced in this proposal and the location of the downstream assessment specifically identified. LUMP SUM FEE: $ 6,000.00 Statements will be submitted monthly as the work progresses and payment will be due within thirty (30) days of the statement date. This proposal is subject to the attached General Conditions of Agreement for Civil Engineering and Surveying Services.
