MEMORANDUM OF OIL AND GAS LEASE

BE IT REMEMBERED that on thea-5 day of R V(, UST , 2010, a Paid Up
Oil and Gas Lease was made and entered into by and between the CITY OF FORT WORTH, a
home rule municipal corporation of the State of Texas, 1000 Throckmorton Street, Fort
Worth, Texas 76102, hereinafter called "(LESSOR)"; and DALE PROPERTY SERVICES,
L.L.C., 2100 Ross Avenue, Suite 1870, L13-9, Dallas, Texas 75201, hereinafter called
("LESSEE"), where LESSOR hereby grants, leases and lets exclusively to LESSEE for the
purpose of exploring for, developing, producing and marketing oil and gas, together with any
liquid or gaseous substances produced in association therewith, from the following described
land situated in Tarrant County, Texas,to-wit:
SEE EXHIBIT"A"ATTACHED HERETO AND MADE A PART HEREOF
Subject to the other provisions therein contained, said lease provides for a primary term
of two (2) years, from the date thereof, and as long thereafter as oil or gas or other substances
covered therein are produced in paying quantities from the leased premises or from lands pooled
therewith, or this lease is otherwise maintained in effect pursuant to the provisions therein.
An Executed copy of said Oil and Gas Lease is in the possession of LESSEE at its
address indicated above.

CONSENT HEARING:
SUBJECT: Conduct a Public Hearing and Authorize Subsurface Drilling and the Extraction of Natural
Gas from an Off Site Location at Andrew"Doc" Session Community Center(COUNCIL
DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code,
Chapter 26, Protection of Public Parks and Recreational Lands;
2. Find that no feasible or prudent alternatives exist to use Andrew "Doc" Session Communuity
Center for the proposed use;
3. Find that the proposed use includes all reasonable planning to minimize harm to the property and
including that the proposed use will have no impact on use of the surface of property as specified on
the attached exhibit and as noted in the discussion below; and
4. Close the public hearing and authorize the City Manager to approve use of the subsurface of
Andrew "Doc" Session Community Center for the drilling and the extraction of natural gas:
Andrew "Doc" Session Community Center- located at 201 S Sylvania Avenue, Mapsco 63U, east o
Sylvania Avenue, north of 4th Street and south of Chenault Street, in Council District 8
DISCUSSION:
In accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Fort Worth seeks to
use the subsurface area of Andrew "Doc" Session Community Center for the purpose of drilling and
the extraction of natural gas from an off site location. This process only proposes the use of the
subsurface and no surface of the property will be disturbed. Attached is a map of the property.
In accordance with State law, the public notice was advertised in the Fort Worth Star-Telegram on
July 20, 2010, July 27, 2010, and August 3, 2010. An exhibit map was available for public review for
30 days at the Parks and Community Services Department administrative offices located at 4200
South Freeway, Suite 2200.
A letter announcing the proposed use was sent to the president of the United Riverside
Neighborhood Association on July 20, 2010. Signage was posted at the site noting the proposal and
providing instructions for directing comments to the Parks and Community Services Department. Sta
will note any public comment received during the Public Hearing, Report of City Staff.
Andrew "Doc" Session Community Center is located in COUNCIL DISTRICT 8.

Dear Jean:
The captioned tract of land is under five acres in size and is not under a requirement to be sent
out for bids. I was able to obtain an offer from Dale Property Services for $ 3,000 per acre bonus
and 25% royalty. I believe that it would be in the best interest of the city to approve this lease.
