("Engineer") made and entered into City Secretary Contract No. (the "Contract") which was authorized by the City Council by M & C C-20292 on September 21, 2004; WHEREAS, the Contract involves engineering services for the following project: Comprehensive Storm Water Management Study WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to for the funding of Phase II and revise Exhibit A-1 to the Contract; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement that amends the Contract: 1. Article 1, of the Contract is amended to include the funding necessary to provide Phase 11 services as authorized by M&C C-20666 dated April 19, 2005. In addition to providing the additional funding for Phase II services, Exhibit A-1 to the Contract is deleted and is replaced with Exhibit A-! attached hereto and made a part hereof for all purposes. The cost to the City for the Phase II services to be performed by Engineer totals$695,024.00 2. Article 11, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$996,748.00 Off 3. May 9,2005 Pagel of 2 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 4/19/2005 - Ord. #16389-04-2005, 16390-04-2005 & 16391-04- 2005 DATE: Tuesday, April 19, 2005 LOG NAME: 20AMEC2 REFERENCE NO.: C-20666 SUBJECT: Adoption of Appropriation Ordinances and Execution of Contract with AMEC Earth & Environmental, Inc. for Phase 2 of the Comprehensive Storm Water Management Study RECOMMENDATION: It is recommended that the City Council authorize the City Manager to: 1. Authorize the City Manager to transfer $185,000 from the Water and Sewer Fund to the Contract Street Maintenance Fund; 2. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Contract Street Maintenance Fund in the amount of$185,000 from available funds; 3. Adopt the appropriation ordinance increasing appropriations in the Environmental Management Operating Fund in the amount of $370,000 and decreasing unreserved retained earnings by the same amount; 4. Authorize the City Manager to transfer $370,000 from the Environmental Management Operating Fund to the Environmental Management Project Fund; 5. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $370,000; and 6. Authorize the City Manager to execute a contract with AMEC Earth & Environmental, Inc. in the amount of$740,000 for Phase 2 of the Comprehensive Storm Water Management Study. DISCUSSION: On September 21, 2004 (M&C C-20292), the City Council authorized a contract with AMEC Earth & Environmental, Inc. for Phase 1 of the Comprehensive Storm Water Management Study. Phase 1 included an update of the City's drainage policies and design standards, review of the current stormwater program, gap analysis and recommendations for an enhanced stormwater program. Phase 2 is a continuation of the original contract and will develop funding strategies to implement the enhanced stormwater program. Phase 2 is scheduled to be completed by November 2005. The fee for this study is considered reasonable for the work proposed. The fee for this project will be shared 25% by Transportation and Public Works ($185,000), 25% by Water Department ($185,000) and 50% Environmental Management ($370,000). AMEC Earth & Environmental, Inc. is in compliance with the City's M/WBE Ordinance by committing to 10% MWBE participation on Phase 2 of this project. The City's goal on this project is 10%.
