HomeMy WebLinkAboutContract 30389 SECRETARY G ,JTRACT NO. CONSULTING AGREEMENT This Consulting Agreement is made and entered into on the 24`h day of August, 2004, by and between Gary W. Jackson ("Jackson") and the City of Fort Worth, Texas ("City"). In consideration of the mutual covenants set forth below, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, the parties agree as follows: 1. By his signature below, Jackson hereby resigns as City Manager. 2. Jackson promises to provide consulting services as requested by the City Manager or Interim City Manager of the City of Fort Worth in connection with city business, including but not limited to advice and counsel concerning the pending budget proposal, assistance in the transition process, and other services as requested, until December 31, 2004, or until Jackson begins full-time employment elsewhere. 3. The City promises to pay Jackson a fee for consulting services in the amount of $8,122.60 every two weeks, beginning September 10, 2004, and ending December 31, 2004. The City's obligation to pay this consulting fee will terminate on the date that Jackson begins full-time employment elsewhere, or December 31, 2004, whichever comes first. 4. Jackson will be paid as wages, subject to the normal payroll deductions, the value of the vacation leave and sick leave Jackson has accrued but not used as of August 24, 2004. 5. The City promises to pay the premium for the continuation of Jackson's current level of health insurance coverage through COBRA through August 31, 2005, or until the date that Jackson begins full-time employment elsewhere, whichever comes first. 6. The City promises to release and not to sue Jackson, and Jackson promises to release and not to sue the City and its employees, council members, agents, and representatives, from and for any and all claims, complaints, grievances, liabilities, promises, agreements, causes of action, and damages, other than any arising from a breach of this agreement, for any actions or omissions whatsoever through the effective date of this agreement, whether known or unknown, relating to or arising from Jackson's employment with the City. Jackson ("Jackson") and the City of Fort Worth ("City") entered into on August 24, 2004. In consideration of the mutual covenants and other valuable consideration that are set forth in the CONSULTING AGREEMENT, the parties further agree the City will pay the premium for the continuation of Jackson's current level of health insurance coverage through July 31, 2005. All of the terms and promises contained in the CONSULTING AGREEMENT (but not in conflict herein) remain in full force and effect.
