MEMORANDUM OF OIL AND GAS LEASE

BE IT REMEMBERED that on the _/_ day of / 3 1, P 2009, a Paid Up
Oil and Gas Lease was made and entered into by and between the CITY OF FORT WORTH, a
home rule municipal corporation of the State of Texas, 1000 Throckmorton Street, Fort
Worth, Texas 76102, hereinafter called "(LESSOR)"; and CHESAPEAKE EXPLORATION,
LLC, P.O. Box 18496, Oklahoma City, Oklahoma 73154, hereinafter called ("LESSEE"), where
LESSOR hereby grants, leases and lets exclusively to LESSEE for the purpose of exploring for,
developing, producing and marketing oil and gas, together with any liquid or gaseous substances
produced in association therewith, from the following described land situated in Tarrant County,
Texas, to-wit:
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF
Subject to the other provisions therein contained, said lease provides for a primary term
of two (2) years, from the date thereof, and as long thereafter as oil or gas or other substances
covered therein are produced in paying quantities from the leased premises or from lands pooled
therewith, or this lease is otherwise maintained in effect pursuant to the provisions therein.
An Executed copy of said Oil and Gas Lease is in the possession of LESSEE at its
address indicated above.

SUBJECT:
Conduct a Public Hearing and Authorize Subsurface Drilling and the Extraction of Natural Gas at Bonnie
Brae Park from an Off Site Location
RECOMMENDATION:
It is recommended that the City Council:
1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter
26, Protection of Public Parks and Recreational Lands; and
2. Close the public hearing and authorize the City Manager to approve the following park for subsurface
drilling and the extraction of natural gas from an off site location:
• Bonnie Brae Park - 3213 Wesley Street, Mapsco 64A, west of Wesley Street, north of Chesser
Boyer Road and south of Fossil Drive, in COUNCIL DISTRICT 4.
DISCUSSION:
In accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Fort Worth seeks to use
the subsurface area of Bonnie Brae Park for the purpose of drilling and extraction of natural gas from an
off site location. This process only proposes the use of the subsurface and no surface of the park will be
disturbed. Attached is the map of the park.
In accordance with State law, the public notice was advertised in the Fort Worth Star-Telegram on
October 20, 2009, October 27, 2009, and November 3, 2009. An exhibit map was available for public
review for 30 days at the Parks and Community Services Department (PACSD) administrative offices
located at 4200 South Freeway, Suite 2200.
A letter announcing the proposed use was sent to the president of the Bonnie Brae Neighborhood
Association on October 23, 2009. Signage was posted at the site noting the proposal and provided
instructions for directing comments to the Parks and Community Services Department. Staff will note any
public comment received during the Public Hearing, Report of City Staff.
Bonnie Brae Park is located in COUNCIL DISTRICT 4.

The Financial Management Services Director certifies that this action will have no material effect on City
funds.
