HomeMy WebLinkAboutContract 29399 AMENDMENT NO. 1 _ STATE OF TEXAS $ CITY SECRETARY CONTRACT NO.C� (No M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Teague Nall and Perkins, (Engineer) made and entered into City Secretary Contract No. 27966, (the Contract) which was authorized by the City Council by M&C C-19206 on the 27th day of August, 2002; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LII (52) WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated November 21, 2003 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $21,750 .00 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $312, 050 . 00 3 . Project No. 3763 Fee Proposal for Contract Amendment No. 1 Dear Mr. Chaubey: Teague Nall and Perkins, Inc. is submitting this fee proposal for Amendment No. 1 to the contract for the above referenced project based on additional services requested. The following is a brief description and cost for the additional services provided on this project: 1. Additional Services to prepare Right-of-Entry and Easement Documents The engineering services contract does not include the preparation of right-of-entry or easement documents. These services were not included in the original contract because the required number of each was not known until the Conceptual Design Plan could be completed. The concept plan and preliminary construction plans have now been completed and the number of right-of-entry agreements and easements are known and are summarized below: • Right-of-Entry Agreements 37 each @ $ 50 per each = $ 1,850 • Permanent Utility Easements 11 each @ $700 per each = $ 7,700 • Temporary Construction Esmts. 11 each @ $350 per each = $3,850 Subtotal Preparation of Right-of-Entry and Easement Documents: $13,400.00 2. Additional Services for Hydrologic and Hydraulic Study of Marine Creek The conceptual design process led to the decision to construct an aerial crossing of Marine Creek for sewer main M-BR instead of replacing the existing siphon. The City subsequently required that TNP prepare a hydraulic study to evaluate the impact of the proposed aerial crossing. TNP prepared the hydraulic study and submitted it to the City's staff hydrologist for review. The study was recently approved. Additional Services for Structural Design of Marine Creek Aerial Crossing As noted above, the conceptual design process led to the decision to construct an aerial crossing of Marine Creek for sewer main M-BR instead of replacing the existing siphon. The design of the aerial crossing includes the structural design of the piers which was not included in the original contract. Subtotal Structural Design of Marine Creek Aerial Crossing: $2,000.00 Total Contract Amendment No. 1: $21,750.00 For additional services provided pursuant to this Amendment No. 1,we request compensation in an amount not to exceed $21,750.00. Such payment shall be made in accordance with the payment terms specified in the Contract. Douglas Rademaker, Director, DOE; and Mike Groomer, Assistant City Manager FROM: Rakesh Chaubey, DOE DATE: December 10, 2003 RE: DESIGN FEE AMENDMENT NO. 1 TO SANITARY SEWER REHABILITAION CONTRACT LII (52) DOE 3763 SEWER PROJECT NO. PS58-070580175070 The proposed amendment will allow Teague Nall and Perkins, Inc. to provide additional services to the project as requested by the City. This amendment is necessary to pay for preparation of right-of-entry and easement documents. The original scope of the contract did not cover easements because the number of easements was unknown and only became clear later on during the course of design when the alignments of the lines were established. Additionally, during the course of design, the City asked the consultant to provide for an Aerial crossing over Marine Creek. Hydrologic Study and Structural design of the aerial crossing, were needed as a consequence to this decision. This amendment covers those items as well. Teague Nall and Perkins, Inc., has submitted a fee in the amount of$21,750.00 for the additional work as described above, thereby increasing the contract fee from $290,300.00 to $312,050.00. I believe this fee is fair and reasonable for the additional length of sewer lines to be designed. It is recommended that the request be approved.
