FORT WORTH AVIATION DEPARTMENT
And
FORT WORTH POLICE DEPARTMENT
MEACHAM INTERNATIONAL AIRPORT

OCCUPANCY AGREEMENT and
ASSOCIATED MANDATORY IMPROVEMENTS
This FIRST AMENDMENT TO MEMORANDUM OF UNDERSTANDING
("MOU")is made and entered into by and between the CITY OF FORT WORTH AVIATION
DEPARTMENT ("Grantor"), acting by and through.William B.Welstead, its duly authorized
Aviation Director, and CITY OF FORT WORTH POLICE DEPARTMENT ("Grantee"),
acting by and through Joel Fitzgerald,its duly authorized Police Chief.
In consideration of the mutual covenants, promises, and obligations, herein, the parties
agree to amend the MOU as follows:
1. Section 3.3 Fuel Flowage Fees is added to read as follows:
"3.3 Fuel Flowage Fees.
The fuel flowage fee rate scale is based on the number of gallons of fuel dispensed
annually.Therefore, on the Effective Date,Grantee will pay a fuel flowage fee payment
of$0.26 per gallon,and the above calculations will begin anew through the following
September 30th;provided,however,that the City Council may,in its discretion,adjust
fuel flowage fees and rate scales for all providers of Fixed Base Operator("FBO")
services and/or self-fueling tenants at the Airport,as may be set forth in the Schedule of
Rates and Charges,in which case the adjusted rates shall be applied.
Payments of the fuel flowage fees are due and payable on the tenth (10th) day of each
month succeeding that in which aircraft fuels were delivered and/or dispensed on the
Premises. Payments must be received during normal working hours by such date at the
location for Grantor set forth in Section 11. This fee shall be considered past due if Grantor
has not received full payment after the fifteenth (15th) day of that month. Grantor will
assess a late penalty charge of ten percent(10%)per month on top of the entire month's fee
for each month in which a fee is past due."
2. This amendment is effective on October 1,2016.

3. All terms and conditions of the MOU not amended herein remain unaffected and in full
force and effect. Capitalized terms not defined herein shall have the meanings assigned
to them in the MOU.
