HomeMy WebLinkAboutContract 30293 AMENDMENT NO.—4 STATE OF TEXAS $ CITY SECRETARY CONTRACT NO. (No M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Kimley-Horn and Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 27675, (the Contract) which was authorized by the City Council by M&C C-19071 on the 30th day of April, 2002 and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Water Distribution System Improvements in the Medical District. WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 9, 2004, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $18,625. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $985,625. 3. All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. EXECUTED on this the day of , 2004, in Fort Worth, Tarrant County, Texas. These items include the following: 1. Project Unit Divisions-Per the request of the M/WBE department, Kimley-Horn revised the plans to include an additional Unit for the construction of the project. The revisions include changes to the cover sheet,plan and profile sheets, sequencing, completing a new bid form and revising the specifications. 2. Cathodic Protection-During the review of the final design of the project,Kimley-Horn was directed to add steel pipe as an alternative pipe material to the contract documents. This pipe material was added to provide for more competition for 24-inch and larger pipe lines. Because the project area is an older area of the City,there is a greater potential for stray current which can adversely effect the design life of steel pipe. The City instructed Kimley-Horn to evaluate,recommend and include cathodic protection system plans and specifications for approximately 5,830 linear feet of 24-inch, 30-inch,and 36-inch water transmission pipeline for this project. This requirement was given with fewer than 30 days to complete and still meet the deadline for the project bid schedule. This change includes sub consultants for geotechnical services and the design of the cathodic protection system. The fees for adding Unit III to the Phase 2 project, and designing the cathodic protection system are $6,900 and$11,725,respectively. Attached is a fee breakdown for each of these tasks. Of the total, $18,625, $8,477 is for the subconsultant expenses. The subconsultants we used were Corrpro Companies, Inc., CMJ Engineering Inc., and GM Enterprises. The total fee for this. _ Amendment will be added to Task 6 Water Line Design and Bidding. The amount we anticipate to subcontract for this amendment is approximately$1,022. Our revised M/WBE commitment would now be $177,347. Since our revised contract amount will be $985,625,the revised total contract M/WBE participation percentage will be 18.0%. The original M/WBE goal for this project was 19.0%.
