PUBLIC FUELING AGREEMENT This RENEWAL AGREEMENT ("Agreement") is made and entered into by and between the CITY OF FORT WORTH ("I.essor"), a home rule municipal corporation organized under the laws of the State of Texas �nd situated in portions of Tarrant, Denton, and Wise Counties, Texas, acting by and through Marc Ott, its duly authorized Assistant City Ivra.nager, and TEXAS JET, INC. ("Lessee"), a Texas corporation acting by and through Reed Pigman, ,Tr,, its duly authorized President. RECITALS The following statements are true and correct and form the basis of this Agreement: A. Lessor and Lessee previously entered into City Secretary Contract ("CSC") No. 23530, (the "Lease"), a lease of real property at Fort Worth Meacham International Airport ("Airport") and agreement giving Tenant the right to store and dispense aviation fuel from a tank farm at the Airport from such property. The Lease commenced on January 26, 1998 and expired on November 30, 2004, subject to renewal at Lessee's option for two (2) additional terms of five (5) years each. B. Pursuant to the terms and conditions of CSC No. , as amended and renewed, styled "Tank Farm Lease and Public Fueling Agreement," Lessee is authorized to operate as a Fixed Base Operator ("FBO") at the Airport; and C. This is the first of two renewal terms of five (5) years each. This renewal term expires on November 30, 2009. Lessee shall have one more option to renew for a term of five (5) years. In accordance with the provisions of the Lease, Lessee has properly exercised its option to renew. AGREEMENT l. The Lease is hereby renewed and extended for a term of five (5) years, commencing on December 1, 2004 and expiring on November 30, 2009. 2. All other teims and conditions of the Lease shall remain in full force and effect. DISCUSSION: City Secretary Contract (CSC) No. 23530, executed on January 22, 1998, gave Texas Jet the right to lease a fuel farm space and conduct transient fueling at Meacham International Airport. The original agreement allowed for two five-year renewal periods. Texas Jet, Inc. has indicated in writing its desire to exercise its option to renew CSC No. 23530 for the first five-year term. This term would be effective December 1, 2004 and expire November 30, 2009. The rental rate of $338.22 per month from this lease provides an annual revenue of $4,058.64. All other terms and conditions of the contract will remain in full force and effect. The property is located in COUNCIL DISTRICT 2. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that the Revenue Office of the Finance Department will be responsible for the collection and deposit of funds due to the City under this Agreement.
