CSJ#0902-48-558 District#02-Fort Worth Code Chart 64#15000 Project: Historic Handley Village Federal Highway Administration CFDA#20.205 Not Research and Development STATE OF TEXAS § COUNTY OF TRAVIS § ADVANCE FUNDING AGREEMENT AMENDMENT#2 THIS AMENDMENT is made by and between the State of Texas, acting through the Texas Department of Transportation, called the State, and the City of Fort Worth, acting by and through its duly authorized officials, called the Local Government. WITNESSETH WHEREAS, the State and the Local Government executed a contract on January 13, of 2011 to effectuate their agreement to design and construct several on and off system locations within the Historic Handley Urban Village; and, WHEREAS, Amendment 1 was executed on April 1, 2011 to add language to Article 10; WHEREAS, the scope of work from the original contract executed January 13 of 2011 is revised to delete three off-system locations; and, WHEREAS, it is necessary to add to the original agreement Green Ribbon Landscaping Planting Program project funding and responsibilities; and, WHEREAS, Rider 15 of Senate Bill 1 of the 82nd Legislature, expands the Green Ribbon Project, a public-private partnership initiative, to include the Green Ribbon Landscaping Planting Program, to enhance the appearance of public highways by incorporating in the design and improvement of public highways the planting of trees and shrubs, integrating public art, and highlighting culturab uniqueness of neighborhoods, and allocates funds for landscaping activities including the planting and establishment of trees and plants on the state highway to help mitigate the effects of air pollution in non-attainment and near non-attainment areas; and, WHEREAS, it has become necessary to amend that contract; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties, the State and the Local Government do agree as follows: AFA-AFA_Amend Page 1 of 3 Revised 04/08111 09-24-12 A CSJ #0902-48-558 District# 02-Fort Worth Code Chart 64#15000 Project: Historic Handley Village Federal Highway Administration CFDA#20.205 Not Research and Development THIS AGREEMENT IS EXECUTED by the State and the Local Government in duplicate. Page 1 of 1 Attachment C-1 CSJ #0002-48-558 District#02 - FTW Code Chart 64 # 15000 Project: City of FTW Corridor Redevelopment Project-Historic Handley Village Federal Highway Administration CFDA#20.205 Not Research and Development ATTACHMENT D Green Ribbon Landscaping Planting Project Responsibilities Contract Period The Green Ribbon Landscaping Planting Project between the State and the Local Government becomes effective upon the date of final execution of this Agreement by the State, and the maintenance responsibilities by the Local Government shall extend from the completion of the landscape installation by the Local Government's contractor, and remain in effect for a five year period. The agreement shall then renew automatically on an annual basis until it is mutually determined by the Local Government and the State the plant materials are sufficiently established to survive without additional care or until this Agreement is terminated or modified as stated in the Master Agreement. Local Government's Responsibilities The Local Government shall install landscaping and irrigation in accordance with the plans and specifications set forth in the Project. The State, having had the opportunity to review the plans, may provide input to the Engineer regarding the installation of the plant material and irrigation system under the contract. Following the completed installation of the landscape items as shown in the plans, the Local Government shall assume maintenance of the Project in accordance with State standards. The Local Government shall: For the work of plant maintenance, provide all reasonable means to preserve the plants existing within the project limits in a healthy and vigorous growing condition. This maintenance activity shall include but not be limited to the following: (1) Water plants and vegetation (2) Plant bed and basin maintenance including shaping, weed control, and mulching/mulch layering (3) Plant replacement after the original plant maintenance period (4) Insect, Disease, and Animal Control (5) Fertilizing (6) Mowing and Trimming (7) Re-staking, re-guying, re-bracing and, when applicable, removal of staking, guying and bracing (8) Pruning (9) Litter pickup Page 1 of 2 Attachment D 0902-48-558 CSJ # District# 02 - FTW Code Chart 64# 15000 Project: City of FTW Corridor Redevelopment Prosect-Historic Handley Village Federal Highway Administration CFDA#20.205 Not Research and Development Irrigation System Operation and Maintenance Permanent irrigation system operation and maintenance shall include, but not be limited to, watering, monitoring, adjustment, repairing, and proper operation of the existing irrigation system as required, to ensure adequate moisture to the plant material existing on the site. It shall also include adjusting the system to keep water off hardscapes. All replacement parts shall be of the same type and manufacturer as originally installed. Substitute parts may be allowed with the approval of the State prior to replacement. Authorize the acceptance a Green Ribbon Landscaping Planting Program grant in the amount of $68,000.00 from the Texas Department of Transportation to fund landscaping improvements, an irrigation system and landscape maintenance costs in the Historic Handley Urban Village streetscape project; 2. Authorize the City Manager to execute a Grant Agreement with Texas Department of Transportation to fund the improvements listed above; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$68,000.00, upon receipt of the grant. DISCUSSION: In response to the Texas Department of Transportation's (TxDOT) call for projects under its Green Ribbon Landscaping Planting Program, Staff requested and was awarded a grant in the amount of $68,000.00 to fund new landscape improvements, an irrigation system, and landscape maintenance costs for one-year in the Historic Handley Urban Village. The Green Ribbon Landscaping Planting Program allocates funds for landscaping activities including the planting and establishment of native and adapted trees and plants on state highways to help mitigate the effects of air pollution in non-attainment and near non-attainment areas. Eligible projects must be located on a state highway within the right-of-way and be under contract in TxDOT's 2013 fiscal year(September 1, 2012 to August 31, 2013). The Historic Handley Urban Village streetscape project, which is funded by a Federal Highway Administration Transportation, Community, and System Preservation (TCSP) grant in the amount of $395,000.00 (M&C G-14062), is located on State Highway 180 (East Lancaster Avenue), a TxDOT on- system highway. The streetscape project is currently under design and includes new landscaping in rain gardens and planter pots, reconstruction of a substandard sidewalk adjacent to the Handley historic storefronts, and installation of a new sidewalk and pedestrian lights across the street from the storefronts. Additional project funding from the TxDOT Green Ribbon Landscaping Planting Program was sought to augment the $395,000.00 TCSP grant. The TxDOT award of$68,000.00 will help ensure adequate funding is available to construct the fully designed streetscape project and will save the City one-year of landscape maintenance costs associated with the project. The TxDOT Green Ribbon Landscaping Planting grant does not require a local match.
