WHEREAlS, the CONTRACT involves engineering services for the following project: Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design. WHERI�AS, it has become necessary to execute Amendment No. 5 to the CONTRACT to include an increased scope of work and revised fee. The CITY has asked Dannenbaum to per-form additional services under this contract for the realignment of 7075 LF of Main 325 (M-325), currently sized as a 42-inch pipe. The limits of the realignment are from approximately Stations 38+19 to 42+58, 109+03 to 158+87 and 173+72 to 189+69 and identified in Exhibit 1-Amendment No. 5 M&C Exhibit. The realignment was necessitated because the current alignment location/orientation across Oncor Electric Delivery and TxDOT Rights-of-Way, and Deer Creel< Park (Fort Worth Parl<s Department) was rejected by these entities. The additional services required for this realignment are as follows: 1) Design- The design for the limits of the realignment identified in Exhibit 1 is to be performed by Dannenbaum Engineering Corporation (DEC). This work is classified as Basic Engineering Services under Part 2—Main 325 ofthe contract. The scope ofservices is as described in Exhibit "A" —General Scope of Services of the original contract and includes subconsultant management. Fee=$49,774. 2) Environmental Assessment — The environmental assessment for the limits of the realignment identified in Exhibit 1 is to be performed by subconsultant Blanton and Associates, Inc. This worl< is classified as Special Services under Part 1—Alignment Study of the contract. The scope of work is described in Exhibit 2— Amendment No. 5 Subconsultant's Scope of Work. Fee=$19,900. 3) Geotechnical Investigation- The geotechnical investigation for the limits of the realignment identified in Exhibit 1 is to be performed by subconsultant GeoTel Engineering, Inc. This worl< is classified as Specia) Services under Part 2-Main 325 Design of the contract. The scope of work is described in Exhibit 2. Fee=$43,189. 4) Survey—The survey worl<for the limits ofthe realignment identified in Exhibit 1 is to be performed by subconsultant ANA Consultants, LLC. It consists of design survey for limits identified in Exhibit 3-Amendment No. 5 Design Survey Limits and easement preparation for the property parcels identified in Exhibit 4-Amendment No. 5 Easement Parcels. This work is classified as Special Services under Part 2-Main 325 Design of the contract. The scope of worl< is described in Exhibit 2. Fee=$36,150. ENGINEER will perform/manage the work described in the items above forthis Amendment in accordance with the original Contract. The iopographical survey shall extend 50' north and/or south of the proposed centerline as shown. In addition to the supplemental topographic survey for the new alignment in parcel 15 area (Deer Creek Park) will tie trees 6" and larger in the new alignment area (100' wide to cover both permanent and construction easements) CONTROL: Recover and/or reset horizontal and vertical control and locate the new survey areas in the ground (match original project control) for the new four areas as shown in the attached exhibit. EASEMENTS: Provide the documents necessary for the acquisition of a 9 permanent sanitary sewer easement and 12 temporary construction easements. DELIVERABLES: Topographical Survey: ANA shall submit an updated 3d file containing 3d points, TIN and contours. The updated file shall contain the previous topographical survey data. Easements: ANA shall submit three signed and sealed Real Property Descriptions and Maps of Survey for each easement to be acquired.(ANA shall provide no more than two revision for each easement document, any additional revision shall considered extra services and will be billed hourly as per exhibit ��B��� DELIVERY: Topographical Survey: ANA shall present deliverables within 30 days of receiving written 'Notice to Proceed'. COMPENSATION: Control: Topographical Survey: Easements: 9 Permanent Sanitary Sewer Easements - 9 Temporary Construction Easements - TOTAL COMPENSATION: Page 1 of 6 $3, 000.00 $15,150.00 $10,800.00 $7,200.00 $36,150.00 EXHIBIT 2 CITY OF FORT WORTH, TEXAS MAIN 325 PARALLEL RELIEF SEWER AMENDMENT NO. 5 SUBCONSULTANTS' SCOPE OF WORK GEOTECHNICAL (GEOTEL) PROJECT INFORMATION: Proposed sewer alignment of Contract Amendment No. 5 will consist of a 42- inch diameter sewer pipeline of 5,056 feet long, from Station 108+31 to Station 158+87, 440 feet long from Station 38+19 to Station 42+59, and 650 feet long realignment from Station 180+50 to 186+70. The bottom of fhe pipeline is planned to be at depths ranging from 15.4 feet to 36.3 feet below existing grade. FIELD AND LABORATORY WORK: Traffic Control and Utility Clearance: Prior to beginning field work, boring locations will be coordinated by GEI personnel with various utility companies to verify clearance of underground utility lines. Traffic control during field operations will also be provided by GEI and will include signage and cones. Soil & Rock borings: A total of 19 borings are proposed to investigate the subsurface conditions along the proposed new sewer alignment. Two borings from the previous investigation will be included in this report. The borings will be generally located at about 500 feet apart. Two borings are planned on both sides of the Highway 35 along the alignment. The borings will be drilled and sampled to depths of 22 to 40 feet (5 feet below the bottom of the proposed pipe) Cohesive soils will be sampled with thin-walled tube samplers. Standard penetration tests will be performed where sandy soils are encountered. Sampling will typically be continuous to a depth of five feet, and at soil changes or a maximum of five feet thereafter. Bedrock will be evaluated by means of the Texas Department of Transportation's Cone Penetrometer Test in the field. ShorE-term groundwater level observations will be made during drilling operations and upon completion. In order to monitor long term groundwater levels, piezometers will be installed in two borings for long term groundwater observation if water is encountered. Long term groundwater level observations were made within severaf weeks after completion of the borings. Laboratory Tests: Atterberg Limits and soii moisture content measurements will be perFormed to classify the soils and to evaluate the physical and engineering characteristics of the subgrade soils. Classification tests consist of liquid and plastic limits (PI's), natural moisture contents, dry weights, percent fines determinations (minus no. 200 sieve), mechanical sieve analyses, and hydrometer tests. Compressive strength of the subsurface cohesive soils will be evaluated by unconfined compression tests. Hand penetrometer tests will also performed to estimate to the soil consistency with depth and between borings. Erosion tests including pH of soil and water, soluble sulfate and soil resistivity tests will be perFormed to evaluate corrosion effects on concrete pipe ENGINEERfNG REPORT: The results of all field and laboratory data will be presented in an engineering report. The report will include recommendations to guide design and construction of the proposed sanitary sewer line. This report will include the following: 1. Boring logs, laboratory test resuits, water level observations and a boring site plan. 2. Discussion of groundwater conditions that may require use of dewatering equipment during construction and discussion of the presence of limestone stratum that could impact construction. 3. Recommended slope rations to be used for open cut excavations for utility excavations. 4. Recommended lateral pressures to be used for the design of bore pit and trench shoring. 5. Allowable bearing pressures for jack supports used in conjunction with micro tunneling. 6. Recommendations concerning trench bedding, backfill and compaction. 7. Recommendations concerning dewatering system. Two hard copies and one electronic copy of our report will be submitted, unless otherv✓ise requested. SCOPE OF SERVICES/ ESTIMATE FOR REALIGNMENT SECTION OF MAIN 325 Generai Scope The general scope of services associated with this Amendment shall include conducting an evaluation of potential jurisdictional waters, habitat assessment for federally listed threatened and endangered species, and cultural resources evaluation/archeological survey for the M-325 segment realignment of the proposed relief sewer pipeline to be funded by the City of Fort Worth. The proposed realignment section that diverges from the previous alignment is approximately 1.5 miles (7,900 linear feet). The detailed scope of services associated with this Amendment are as follows: Detailed Scope Specific tasks to be performed include: 1) Delineation of wetlands and evaluate streams within the proposed area of impact for the new alignment area and evaluation of applicability of the project under Nationwide Permit No. 12 (NWP- 12) under Section 404 of the Clean Water Act (CWA) (Section 404) 2) Preparation and submission of a letter report to the City of Fort Worth regarding the findings of the Section 404 evaluation 3) Habitat assessments for federaily listed threatened and endangered species in the new alignment area under the regulations of the federal Endangered Species Act (ESA) 4) Preparation and submission of a letter report to the City of Fort Worth regarding the findings of the federally listed threatened and endangered species habitat assessment for the new alignment area 5) Archeological survey for the new alignment area and all coordination with the Texas Historical Commission (THC) regarding the archeological survey as regulated by the Texas Antiquities Code (TAC) 6) Preparation and submission of the archeological survey report to the THC and address any comments from the agency 7) Preparation and submission of a letter report to fhe City of Fort Worth regarding the findings of the archeologicai survey and a summary of coordination with the THC Costs and Schedule We are prepared to conduct the additional field work, as well as prepare and submit the revised coordination and findings letters to the THC and the City of Fort Worth within 90 days of notice to proceed. The estimated cost to complete the scope of services as described above is $19,900.00, to be billed on a lump sum basis. DISCUSSION: On July 30, 2002, Mayor and Council Communication (M&C C-19172) the City Council authorized an Engineering Agreement with Dannenbaum Engineering Corporation, in the amount of $721,899.76 for the Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design from Hemphili Street to West Rendon Crowley Road. The Agreement was revised by four previous amendments totaling $598,866.52, as follows: Amendment No. 1 in the amount of $111,800.52 authorized January 20, 2004 (M&C C-19936) Amendment No. 2 in the amount of $329,406.00 authorized November 27, 2007 (M&C C-22535) Amendment No. 3 in the amount of $96,825.00 authorized June 9, 2009 (M&C C-23578); and Amendment No. 4 in the amount of $60,835.00 authorized March 22, 2011 (M&C C-24794). Amendment No. 5 will provide additional engineering services for the design of a portion of Main 325 crossing Oncor property and TXDOT ROW in IH-35W to conform with their standards for utility crossings. The proposed scope of services consists of: Plan preparation, design survey, geotechnical M&C Review Page 2 of 3 engineering, environmental assessment, permitting and ROW/easement services. in addition to the amendment amount, $2,126,000.00 is required for project management, and real property acquisitions. This project is anticipated to be included in a future revenue bond issue for the Water and Sewer Fund. Avaifable cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation authority authorized under the Direct Purchase Note program will be used to provide interim financing for this project until debt is issued. To the extent resources other than the Water and Sewer portfolio are used to provide interim financing, the Water and Sewer Fund will be charged interest that is equivalent to the overall rate of return being earned by the City portfolio (currently approximately one-percent annually). Should the City's portfolio not support the liquidity needed to provide an interim short-term financing source, another funding source will be required, which could mean issuance of securities under the Direct Purchase Note program or earlier issuance of Water and Sewer revenue bonds than is currently planned. Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the attached Reimbursement Resolution. The City Council adopted the Water Department's Fiscal Year 2016-2020 Five-Year Capital Improvement Plan on February 2, 2016 (M&C G-18662). This City Council adopted plan includes this specific project, with funding identified through the DPN program to be reimbursed with future revenue bonds. In accordance with the provisions of the Financial Management Policy Statements, Staff anticipates presenting revenue-supported debt issuances to the City Council for consideration within the next three years. This debt must be issued within approximately three years to provide reimbursement for these expenses. If that does not occur, the costs will no longer be reimbursable by issuing tax-exempt debt and the funding source will have to be made whole through other budgetary methods. Adoption of this Resolution does not obligate the City to sell bonds, but preserves the ability to reimburse the City from tax-exempt bond proceeds. Engineering for the Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design is one component of the overall project that includes project management, easement acquisition, utility coordination, materiaf testing, inspection, construction, and contingencies. The overall project budget is $12,500,000.00. Design is expected to be completed by August 2017.
