HomeMy WebLinkAboutContract 31845 CITY SECRETARY CONTRACT N0. -3kVc� INTERLOCAL AGREEMENT BETWEEN THE FORT WORTH INDEPENDENT SCHOOL DISTRICT AND THE CITY OF FORT WORTH STATE OF TEXAS § § SYCAMORE SCHOOL ROAD COUNTY OF TARRANT § This Agreement is entered into by between the Fort Worth Independent School District, acting by and through Joe Ross, its duly authorized Interim Superintendent, hereinafter referred to as FWISD, and the City of Fort Worth, acting by and through Marc A. Ott, its duly authorized Assistant City Manager hereinafter referred to as Fort Worth, both of Tarrant County, State of Texas. WHEREAS, this Agreement is made under the authority of Sections 791.001 - 791.029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public and that the division of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, each governing body agrees to share in the cost of the services as stated below. NOW THEREFORE, FWISD and Fort Worth agree as follows: 1. Project. Fort Worth and FWISD agree to cooperate as described herein for the design and construction of a 480-foot section of Sycamore School Road, from Trail Lake Drive to Star Ridge Drive, hereinafter referred to as the "Project". 2. Design of the Project. Fort Worth shall be responsible for the design of the Project and the preparation of the contract documents. FWISD understands that Fort Worth has retained the services of HDR Engineering, Inc. to prepare the design for the Project at a cost of$21,953. FWISD has reviewed the plans so prepared and approves the plans, not as to engineering but as to concept. `UNRIJ,R pexob �1R 3. Award of Contract, Construction, and Maintenance. Fort Worth shall be responsible for: a. The competitive bidding and award of the construction contract for the Project; b. Inspection of the Project; c. Operation and maintenance of Sycamore School Road after completion and acceptance of the Project. 4. Cost. FWISD agrees to participate in the cost of the Project in the sum $54,108. Fort Worth will be responsible for any and all costs required in excess of such FWISD participation. 5. Nothing in the performance of this Agreement shall impose any liability for claims against FWISD other than claims for which the Texas Tort Claims Act may impose liability. 6. Nothing in the performance of this Agreement shall impose any liability for claims against the City other than claims for which the Texas Tort Claims Act may impose liability. 7. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement. 8. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those stated in the Agreement; further, this Agreement shall not create any rights in any party not a signatory to the Agreement. 9. This Agreement shall automatically terminate upon completion of the projects or one (1) year from the date of this agreement, which ever occurs first. 10. Director ,i- act Authorization FWISD FORT WORTH INTERLOCAL AGREEMENT SYCAMORE SCHOOL ROAD wPage 3 of3 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 1/25/2005 DATE: Tuesday, January 25, 2005 LOG NAME: 20SYCAM SCH RD REFERENCE NO.: **G-14658 SUBJECT: Authorize Execution of an Interlocal Agreement with the Fort Worth Independent School District for the Construction of Sycamore School Road RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute an agreement with the Fort Worth Independent School District for the construction of the northern two lanes of Sycamore School Road from Trail Lake Drive to Star Ridge Drive including an adjacent sidewalk and a left turn lane at Trail Lake Drive. DISCUSSION: This 480 foot section of Sycamore School Road is the only two-lane section remaining for this four-lane roadway. Construction of this portion of Sycamore School Road will eliminate the bottleneck at this location and improve traffic flow and safety in the area. The City initiated discussion concerning the joint funding of this project with the Fort Worth Independent School District (FWISD) in May 2003 since they own property adjacent to this section of roadway. Though the FWISD is not planning to develop the site in the near future, it has agreed to participate in the cost of construction of the roadway now. On December 14, 2004, the FWISD Board of Education approved FWISD participation for the section of roadway adjacent to its property in the amount of $54,108. The remaining cost of the project including design, engineering services and the remaining construction is estimated to be $56,000 and is being funded through City Council District 6 undesignated funds. On June 22, 2004 (M&C C-20119), the City Council approved an engineering contract with HDR Engineering, Inc. for the design of this project. The design is complete and the project is ready to go to construction. This project is located in Council District 6, Mapsco 103J.
