(M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and URS Corporation (Engineer) made and entered into a City Secretary Contract No. 31731 (the Contract) which was authorized by City Council by M&C C-20492 on the 181h day of January, 2005; and subsequently revised by three previous Amendments, No I for$138,058 on April 4, 2006, (M&C C-21390); Amendment No. 2 for$86,890 on May 8, 2007 (M&C C-22107); and Amendment No. 3, for$33,732 on November 27, 2007 (M&C C- 22530). WHEREAS, the Contract involves engineering services for the following project: Engineering, Contract for Updating the Federal Aviation Regulation-Part 150 Noise Compatibility Study for Fort Worth Alliance Airport. WHEREAS, it has become necessary to execute Amendment No. 4, to said contract to include increased scope of work and revised maximum fee: NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the contract: I. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated August 28, 2008, a copy of which is attached hereto and incorporated herein. The cost to the City of the additional services to be performed by Engineer total $88,820. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$647,380. This includes the coordination with Alliance Airport and the City of Fort Worth regarding contract amendments, etc. Task 1.2 Project Management Throughout the duration of the project, the Project Manager and Deputy Project Manager will be coordinating as necessary with Airport staff, City representatives and others to ensure that the project and schedule are progressing as planned. This on-going coordination will provide the Airport staff with a consistent, single point-of- contact throughout the duration of the project. Included under this task will be any coordination meetings required outside the scope of the meetings with the Technical Advisory Committee and all project review meetings. TASK 2 LAND USE MAPPING NOTE: This task will not require revision. Therefore, there is no additional cost for this task in this scope of services. TASK 3 INVENTORY OF AIRPORT AND AIRCRAFT OPERATIONS Task 3.1 Collect Aircraft Operations Data This task includes coordination with American Airlines regarding changes in their fleet mix and operations as well as discussion with FedEx to determine whether current schedule changes due to economic conditions have any long term impact on their activity projections. Data will be collected to aid in the determination of August 28, 2008 Page 1 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update proposed changes in American Airlines operations which will be incorporated into the revised Future Condition NEM. Data to be collected and analyzed will include the following: • Number and type of operations • Ground run-up and maintenance activities • Day/night usage Task 3.2 Review Existing Aviation Plans and Studies This task includes coordination with FAA regarding the removal of F-5 operations. It has been determined that the FAA's TAF for 2008 (dated 6/19/08 as provided by Paul Blackford on 8/14/08) does not include the F-5 operations. Therefore, the airport operations for 2014 (as shown on the aforementioned TAF) will be utilized to update the Future Condition NEM for AFW. Task 3.3 Working Paper B Working Paper B became Section 3, Airport and Aircraft Activity in the Noise Exposure Maps and Supporting Documentation. Section 3, Airport and Aircraft Activity in the Noise Exposure Maps and Supporting Documentation will be revised to incorporate the 2008 TAF airport operations for 2014 and the American Airlines fleet mix and operational changes. • An electronic copy (PDF format) of revised Section 3, Airport and Aircraft Activity in the Noise Exposure Maps and Supporting Documentation will be submitted to Alliance Airport staff for review and comment. • URS will be responsible for all preparation of Section 3, Airport and Aircraft Activity in the Noise Exposure Maps and Supporting Documentation and will provide an electronic copy (PDF format) to a DBE Subconsultant for reproduction of all hard copies. TASK 4 EXISTING NOISE CONTOURS NOTE: This task will not require revision as a result of removing F-5 operations or changes to American Airlines fleet mix and operations. Therefore, there is no additional cost for this task in this scope of services. TASK 5 FUTURE NOISE CONTOURS Task 5.1 Develop 2014 Noise Contours The operational changes identified in Task 3 will be compiled and analyzed to August 28, 2008 Page 2 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update determine the operational characteristics for the average annual day for the five-year (2014) forecast period. This information will be formatted for input into the FAA's Integrated Noise Model (INM), Version 7.0. The future noise contours will be developed for the proposed 11,000-foot runway lengths. Revised noise contours including both flight operations and engine run-up operations will be generated at DNL 60, 65, 70, and 75 dB. The INM standard grid analysis feature will be used to re-calculate DNL values at up to 20 noise-sensitive sites. The Feasibility Analysis for Noise Mitigation at NISD Alliance Campus Facilities will be revised to incorporate revised future noise contours and noise levels resulting from the operational changes described in Task 3. Copies of the revised document will be submitted to AFW and the FAA for review and approval. A total of 5 hard copies and 30 CDs will be produced. Task 5.2 Evaluate Impacts of 2014 Noise Contours The revised DNL 60, 65, 70 and 75 dB noise contours which where developed in Task 5.1 will be incorporated into the GIS database in order to more accurately quantify noise exposure in terms of population, households, and land use. Tables will be developed from the GIS to describe the noise exposure estimates for the revised future conditions. Graphics will be prepared to illustrate the revised noise contours superimposed over the base mapping and land use. Noise compatibility will be determined by comparing the anticipated DNL noise levels with existing land use and the FAA land use compatibility guidelines provided in Table 1 of Appendix A of 14 CFR Part 150. Task 5.3 Working Paper D Working Paper D became Section 5, Future Conditions: Year 2014 Noise Exposure in the Noise Exposure Maps and Supporting Documentation. Section 5, Future Conditions: Year 2014 Noise Exposure in the Noise Exposure Maps and Supporting Documentation will be revised to incorporate the changes described above. • An electronic copy (PDF format) of revised Section 5, Future Conditions: Year 2014 Noise Exposure in the Noise Exposure Maps and Supporting Documentation will be submitted to Alliance Airport staff for review and comment. • URS will be responsible for all preparation of Section 5, Future Conditions: August 28, 2008 Page 3 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update Year 2014 Noise Exposure in the Noise Exposure Maps and Supporting Documentation and will provide an electronic copy (PDF format) to a DBE Subconsultant for reproduction of all hard copies. TASK 6 NEM CONSULTATION AND PUBLIC INVOLVEMENT The project will include sufficient consultation and public involvement to meet the requirements of the Part 150 process. The airport operator must afford interested persons adequate opportunity to submit their views, data, and comments concerning the correctness and adequacy of the draft noise exposure map and descriptions of forecast aircraft operations. Task 6.1 Identify and Notify§ 150.21 (b) "Consulted Parties" NOTE: Task 6.1 was completed therefore no additional costs for this task are included in this scope of services. Task 6.2 Hold Open House Public Information Meeting One open house public information meeting will be held to inform the public about the revised Noise Exposure Maps for AFW, and to obtain comments from the public. The public meeting will be conducted to present the revised findings of Tasks 3 and 5. URS will prepare up to ten revised full-size presentation boards for the Public Information meeting. One hand-out of up to ten pages will be prepared to present summary information to the public. Comment forms will be provided for individuals who wish to submit written comments. URS will prepare the hand-out and comment form and provide 30 B&W hard-copies and one electronic (PDF format) of the handout and comment form to Alliance Airport staff. DBE subconsultants will assist in the plotting and mounting of the presentation boards and reproduction of the hand- out materials. Up to four Consultant staff will attend the Public Meeting. URS Corporation will provide a camera-ready public notice to the Alliance Airport and City of Fort Worth Aviation Department staff for their distribution to announce the time and location of the public meeting. The City of Fort Worth will be responsible for providing for the necessary facilities for the public meeting, notifying the public of the time and location of the meeting, and publishing the public notice in area newspapers. Task 6.3 Compile and Analyze Public Comments All additional comments received on the Part 150 Study, including letters and comment forms, will be compiled and analyzed. Responses will be drafted as August 28, 2008 Page 4 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update appropriate and provided to the Alliance Airport and City of Fort Worth Aviation Department staff for review and approval. The comments will be included in an appendix to Working Paper E. Task 6.4 Present Information to City of Fort Worth Aviation Advisory Board URS Corporation will attend one City of Fort Worth Aviation Advisory Board meeting in order to present the revised Future Condition NEM. The presentation will occur near the completion of Phase 1. A handout package will be prepared for distribution to the Aviation Advisory Board. URS will prepare the hand-out and provide 20 hard- copies and one electronic (PDF format) of the handout to Alliance Airport staff. A DBE subconsultant will assist reproduction of the hand-out materials. Task 6.5 Attend City Council Meeting URS Corporation will not attend the regular City Council meeting when the approval of the FAR Part 150 Noise Exposure Maps is on the agenda, therefore no additional costs for this task are included in this scope of services. Task 6.6 Working Paper E Working Paper E became Section 6, Consultation and Public Participation in the Noise Exposure Maps and Supporting Documentation. Section 6, Consultation and Public Participation in the Noise Exposure Maps and Supporting Documentation will be revised to document the additional public involvement described above. • An electronic copy (PDF format) of revised Section 6, Consultation and Public Participation in the Noise Exposure Maps and Supporting Documentation will be submitted to Alliance Airport staff for review and comment. • URS will be responsible for all preparation of Section 6, Consultation and Public Participation in the Noise Exposure Maps and Supporting Documentation and will provide an electronic copy (PDF format) to a DBE Subconsultant for reproduction of all hard copies. August 28, 2008 Page 5 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update TASK 7 NEM REPORT PREPARATION Sections 3, 5 and 6, revised in tasks above, will be incorporated into the Noise Exposure Maps and Supporting Documentation, which will be submitted to FAA for their consideration under 14 CFR Part 150. Three versions of the revised NEM document will be prepared over the course of the study. Quantities of each version are estimates of the City of Fort Worth's needs. The cost estimate is based on the quantities indicated below. If additional copies are determined to be necessary, they will be printed and charged to the City of Fort Worth on a per copy basis. Task 7.1 Prepare NEM Version 1 Version 1 of the revised Noise Exposure Maps and Supporting Documentation will be submitted to the Alliance Airport and City of Fort Worth Aviation Department staff for review and comment. Task 7.2 Prepare NEM Version 2 Version 2 of the revised Noise Exposure Maps and Supporting Documentation will incorporate comments from Alliance Airport and City of Fort Worth Aviation Department staff, and will be the version submitted to the FAA for their review and acceptance. Task 7.3 Prepare NEM Version 3 Version 3 of the revised Noise Exposure Maps and Supporting Documentation will incorporate the FAA's notice of acceptance, and will be the final NEM document for the project. NOTE: Task 7.3 and its associated cost, which have not been completed, were included in the original scope services. Therefore, there is no additional cost for this task in this scope of services. TASK 8 PROCEDURAL REQUIREMENTS TO LIMIT RECOVERY OF DAMAGES URS Corporation will provide a revised camera-ready public notice to the Alliance Airport and City of Fort Worth Aviation Department staff for their distribution to newspapers. The City of Fort Worth will be responsible for placing the advertisements, which should be placed once a week for three consecutive weeks in one or more of the following newspapers (or others as deemed more appropriate): • The Commercial Recorder • The Fort Worth Star-Telegram • The Denton Record-Chronicle • The Burleson Star • Alliance Regional Newspaper August 28, 2008 Page 7 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update PHASE 2 - NOISE COMPATIBILITY PROGRAM UPDATE TASK 9 PROJECT MANAGEMENT This task involves the mobilization, coordination and management of the non-technical aspects of Phase 2 of the project. Progress reports will be prepared as needed and provided to the Alliance Airport and City of Fort Worth Aviation Department staff. Project management meetings will be held in Fort Worth to coordinate with the Alliance Airport staff regarding Phase 2 of the project. TASK 10 OPERATIONAL NOISE ABATEMENT MEASURES Operational measures which are required by the FAA to be considered as part of the Part 150 process will be evaluated for their applicability and effectiveness at AFW. Task 10.1 Model Alternative Scenarios Operational noise abatement alternatives previously identified and modeled will be revised to remove incorporate the changes described in Task 3. Task 10.2 Evaluate Noise Impacts of Alternative Scenarios Noise exposure for the alternative scenarios will be re-calculated with the GIS and quantified in terms of population, households and land use. Task 10.3 Working Paper F Working Paper F will be revised to incorporate the changes described in Tasks 10.1 and 10.2, above. • An electronic copy (PDF format) of revised Working Paper F will be submitted to Alliance Airport staff for review and comment. • URS will be responsible for all preparation of Working Paper F, Operational Noise Abatement Measures and will provide an electronic copy (PDF format) to a DBE Subconsultant for reproduction of all hard copies. TASK 11 LAND USE NOISE MITIGATION MEASURES Land use noise mitigation measures which are required by the FAA to be considered as part of the Part 150 process will be evaluated for the applicability and effectiveness at AFW. Task 11.1 Evaluate Remedial Land Use Mitigation Measures Existing non-compatible land uses will be identified in detail within the revised NEM August 28, 2008 Page 8 of 9 SCOPE OF SERVICES Alliance Airport - Part 150 Update and potential corrective land use measures will be evaluated. Task 11.2 Evaluate Preventive Land Use Measures The preventive land use measures currently under evaluation will be re-evaluated in light of the revised NEM. Task 11.3 Working Paper G Working Paper G will be revised to incorporate the changes described in Tasks 11.1 and 11.2, above. • An electronic copy (PDF format) of revised Working Paper G will be submitted to Alliance Airport staff for review and comment. • URS will be responsible for all preparation of Working Paper G, Land Use Measures and will provide an electronic copy (PDF format) to a DBE Subconsultant for reproduction of all hard copies. DISCUSSION: In 1991, the City conducted FAR Part 150 Noise Compatibility Studies at Meacham and Alliance Airports. Since that time the activity at Alliance Airport has changed significantly and development around the airport has been occurring. An update of the FAR Part 150 Noise Compatibility Study is needed. On January 18, 2005, (M&C C-20492) the City Council authorized the City Manager to execute a contract for consulting services with URS Corporation in the amount of$299,880.00 to update the FAR Part 150 Noise Compatibility Study for Fort Worth Alliance Airport. The City had previously accepted a grant from the Federal Aviation Administration (FAA) for this work. On April 4, 2006, (M&C C-21390) the City Council authorized Amendment No.1 in the amount of $138,058.00 to conduct custom profiles for military aircraft to conduct noise monitoring. On May 8, 2007, (M&C C-22107) the City Council authorized Amendment No. 2 in the amount of $86,890.00 to update the forecast and assess the impacts of additional activity projected as a result of aircraft to be owned by Northern General Leasing, LLC, and based at Alliance Airport. On November 27, 2007, (M&C C-22530) the City Council authorized Amendment No. 3 in the amount of $33,732.00 to updated noise exposure maps and conduct an additional public meeting due to a new version of the FAA Integrated Noise Model going into effect. The FAA has now requested that the noise contours be run once again to remove activity associated with anticipated additional activity projected as a result of aircraft owned by Northern General Leasing, LLC, not being based at Alliance Airport as previously proposed. This amendment will generate new contours based on a forecast of activity for the year 2014, which will require an additional public meeting to advise the public of any changes and address revisions to work previously done under the noise compatibility plan process following the acceptance of the previous Noise Exposure Map. City staff considers this fee to be fair and reasonable for the scope of services performed.
