This is a letter agreeinent wherein The Burlington Northern and Santa Fe Rail�vay Company, hereinafter called Company, agrees that the eaisting crossing surface at McCart Avenue is to be removed and new concrete crossing surface is to be installed to a crossing surface width of 64 feet on the one track and 72 feet on the second track for a total crossing surface length of 136 feet. To accomplish this work, the City of Fort Worth, Telas, hereafter called Agency, and the Company, agree as follows: 1) The work will be performed at the expense of the Company. Said work will consist of the installaUon of concrete crossing surface inaterial including upgrades to the track to accommodate new concrete crossing surface material, to adequately include all vehicular driving lanes, based on a width of 64 and 72 feet from the end of crossing to end of crossing, including walkways. 2) The Agency will pay the Company $250 per foot far the total crossing surface length for work described above for a total cost of $34,000. 3) The Company will order the Omvi precast concrete crossing surface inaterial or an approved equal from a qualified supplier and after receipt of the material, the Agency will be billed on basis of Paragraph 2 above. 4) The Coinpany, at its own cost and eapense, will maintain the crossing surface in a satisfactory manner and will make ample provisions for such inaintenance, provided, however, that the Coinpany shall be entided to receive any contribution toward the cost of such n►aintenance as may be now or hereafter made available by reason of any law, ordinance, regulation, order, grant, or by other means or sources. 5) The Agency will provide all barricades, lights, and traffic control devices necessary for detouring velucular h�affic at the crossing, during construcUon of the crossing involved. This work will be performed at the e�pense of the Agency. 6) T'he Agency further agrees to allow the Company to drain the crossing area into eaisting Agency storm sewers, if available, near the crossing. The dr�in pipes and filter fabric will be furnished and installed by the Company. 7) The Company, at its own cost and expense, will remove a portion of the existing roadway surface, furnish and place asphalt between flie removed portion and the new concrete crossing surface. 8) Bodi parties agree to the requirements of Title VI of the Civil Rights Act of 1964, which by reference is made a part of this agreement. T'he work proposed above is ageeable to the Company under the terms and consideration stated herein. If this is saUsfactory and agreeable to the Agency, please indicate concurrence in the space provided. The railroad surface crossings on McCart Avenue are severely deteriorated and need to be replaced. Under this cost share agreement between the City and the Burlington Northern and Santa Fe Railway Company, the railway company will remove and replace the existing crossings with concrete crossing material and will provide all the material, labor, equipment, supplies and incidentals necessary to install the concrete crossing surfaces on the two existing tracks. Additionally, the Burlington Northern and Santa Fe Railway Company will furnish and place the asphalt transition between the crossing surfaces and the existing roadway. The City will provide all barricades and traffic control devices for this project, and will reimburse the railway company for the material at a cost not to exceed $34,000. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available iri the current ca�ital budget, as appropriated, of the Street Improvements Fund.
