AMENDMENT No. 1 TO CITY SECRETARY AGREEMENT No. 48077 WHEREAS,the City of Fort Worth (CITY) and Dunaway Associates, LP, (CONSULTANT) made and entered into City Secretary AGREEMENT No. 48077, (the AGREEMENT) which was City Council authorized on the 21 day of June,2016 in the amount of$73,600.00; and WHEREAS,the AGREEMENT involves professional surveying services for the following project: Plat of Forest Park;and WHEREAS, it has become necessary to execute Amendment No. 1 to the AGREEMENT to include an increased scope of work and revised fee. NOW THEREFORE,CITY and CONSULTANT,acting herein by and through their duly authorized representatives,enter into the following agreement,which amends the AGREEMENT: 1. Article I of the AGREEMENT is amended to include the additional professional surveying services specified in a proposal dated January 24,2017,a copy of which is attached hereto and incorporated herein.The cost to CITY for the additional design services to be performed by CONSULTANT totals $3,070.00. (See Attached Funding Breakdown Sheet,Pg. 3) 2. The first sentence of Article III of the AGREEMENT is amended to be and read as follows: CITY shall pay CONSULTANT and amount not to exceed$76,670.00 as set forth in Exhibit"B" and Amendment No. 1 to the AGREEMENT, which are attached hereto and incorporated herein for all purposes, and in accordance with the provision of this AGREEMENT. 3. All other provisions of the AGREEMENT, which are not expressly amended herein, shall remain in full force and effect. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the award and execution of a professional services contract with Dunaway Associates, L.P., in the amount of$73,600.00, for the research and survey necessary to develop a plat for Forest Park. Established in 1910, Forest Park is approximately 181.91 acres and includes the 2.5 acre Log Cabin Village and the 58.53 acre Fort Worth Zoo. On October 1, 2010, the City of Fort Worth and the Fort Worth Zoological Association (Zoo Association) entered into an Agreement(City Secretary Contract No. 40564) establishing the terms and conditions of management of the Fort Worth Zoo (Zoo). As a condition of this Agreement(Art. 3.06), the City is responsible for bearing all costs and expenses associated with the platting process. The scope of services for this contract includes research, survey and mapping needed for filing of plat documents. Staff agrees that the fee of$73,600.00 is a fair and reasonable amount for the services provided. At the conclusion of the project, the excess balance of appropriated funding will be used for future Forest Park improvements. M/WBE OFFICE -A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Park and Recreation Department and approved by the M/WBE Office, in accordance with the BDE Ordinance, because the purchase of goods or services from source(s)where subcontracting or supplier opportunities are negligible. The project is anticipated to commence in June 2016 with an estimated completion date in September 2016. The project schedule is approximately 120 calendar days.
