(ENGINEER) made and entered into City Secretary Contract No. 43816, (the CONTRACT) which was authorized by M&C C-25847 on the 18th day of September, 2012 in the amount of $410, 620.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Southeast Water Main Extensions including a twenty-four inch water main extension along Anglin Drive, Timberview Drive and Shelby Road to Fossil Hill Drive and a similar extension along Joel East Road and Wichita Street; and WHEREAIS, it has become necessary to execute Amendment No.1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal September 22, 2016 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $64,860.00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $475,507.00. 3. City of Fort Worth Water Department 311 W Tenth Street Fort Worth, Texas 76102 Re: Fee Proposal for Contract Amendment No. 1 — Southeast Water Main Extensions City of Fort Worth Project No. 01985 (TNP Project No. FTW 12183) Dear Mr. Chaubey: Teague Nall and Perkins, Inc. is submitting this fee Amendment for the above referenced contract based on additional services required.The following is a brief description and cost for the additional services to be provided on this project: I. Realignment of Water Main 1 A. Additional Survey When the Southeast Water Main Extensions project originally began in 2012, the "Main 1" water line was designed such that it would be located within the existing right of way of Shelby Drive and Timberview Drive, outside of the Timberview Golf Course. Plans and specifications reached 90% completion with this alignment before the project was put on indefinite hold in July of 2014 due to Bethesda's lack of commitment to purchasing water from the City of Fort Worth. In April of 2016, the City contacted Teague Nall and Perkins(TNP) stating that the City wanted to proceed with completing the plans and to construct Main 1. Between the time the project was put on hold in July 2014 and work on the project resumed this year, the Timberview Golf Course was sold in December 2015. When the golf course sold,the property was platted and a thirty(30)foot water line easement was dedicated within the property. The City has directed TNP to revise the alignment of the water line such that it will now be located in the water line easement and outside of Shelby Drive and Timberview Drive right of way. This will require surveying the area within the thirty foot easement, a total length of 3,400', see Attachment A. B. Revise Water Line Alignment and Plan Sheets Once the additional survey is complete,additional effort will be required to revise the alignment and profile. The additional survey will also have to be incorporated into the design CAD base file and sheets will have to be re-cut for the new alignment. C. Additional Submittal and City Review(95% Submittal) TNP had already received and addressed the City's 90%comments for the original design in 2014. By revising the alignment and profile, another (95%) submittal will be required to allow for City review and addressing of those additional comments. II. Control Valve Design The original intent of the Southeast Water Main extensions project was to loop Southside 2 pressure plane water lines by constructing Water Mains 1 and 2 and moving an area of Eastside 2 into Southside 2. Due to concerns over pressure increases associated with moving the area of Eastside 2 into Southside 2 calculated during the water modeling process, the decision was made to instead backfeed Eastside 2 with Southside 2 water at a location near the intersection of Everman- Kennedale Rd and Anglin Rd. This backfeed will require the design of a transfer valve, valve vault, and electrical components related to the pressure transmitters, flowmeter, and SCADA that was not within the scope of the original Contract. The design will be for a transfer valve of similar design to one used in the Westside III& IV Improvements Project, City Project No. 01988,and Morning Mist Trail and Indigo Sky Drive, City Project No. 02688, that was cited by City Staff as the preferred option. 111 A.d.1'4i�r.�1 Cac.�mPreparation .-dudiflwon 1, E.s-.Imen� There are six (6) additional easements (12 total) required for construction of the proposed water lines in the Southeast Water Main Extensions project. The project was originally scoped such that Gorrondona and Associates would provide four (4) easements within the area they provided topographic and design survey along Shelby Rd.and Timberview Drive.The Contractwas also scoped such that ANA Consultants would provide two (2) easements within the area they provided topographic and design survey along Joel East. It has been determined that twelve (12) easements will be required within the area Gorrondona surveyed and none within the area ANA surveyed. This results in eight (8) additional easements to be prepared by Gorrondona and two (2) less easements to be prepared by ANA. It is proposed that the money originally committed to ANA for easement preparation ($2500) be reallocated to Gorrondona and an additional $5300 is requested for Gorrondona to prepare the six (6) additional easements, see attached M/WBE Request for Approval of Change Form. Fee Proposal for Contract Amendment No. 1: $64,860 TNP proposes a fixed fee of$64,860 to accomplish the scope of services described above. MIWBE Utilization: TNP commits 51%of the work covered under this amendment to a certified M/WBE firm. With this amendment, the overall M/WBE commitment will now be 26.8%, above the City's M/WBE goal of 17%. DISCUSSION: On September 18, 2012, Mayor and Council Communication (M&C C-25847), the City Council authorized the execution of an Engineering Agreement with Teague Nall and Perkins, Inc., in the amount of $410,620.00, for the Southeast Water Mains Extension Project. This agreement requires additional funding for project management material testing and to cover costs associated with Amendment No. 1, in the amount of$64,860.00, that will provide for additional design and survey services on the project. In addition to the amendment amount, $30,000.00 is required for project management and material testing. This project will have no impact on the Water Department's operating budget when completed. Design is expected to be completed by March 2018. Construction is expected to start in August 2018 and be completed by May 2019. The total cost for the Southeast Water Main Extensions project is estimated to be$2,830,000.00. The project is located in COUNCIL DISTRICT 5, Mapsco 106Q, 106R, 107E, 107J, 107N. and 107T. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water Capital Fund. The Fiscal Year 2017 Water Operating Budget includes appropriations of $21,060,000.00 for the purpose of providing Pay-As-You-Go Funding for Capital Projects. After this transfer for Fiscal Year 2017, the balance will be $12,906,270.00.
