HomeMy WebLinkAboutContract 47954-A1 CSC Number (IM15-11- 1 STATE OF TEXAS § § KNOWN ALL BY THESE PRESENTS: COUNTY OF TARRANT § FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 47954 THIS FIRST AMENDMENT to City Secretary Contract No. 47954 is entered into by and between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas, acting through Fernando Costa, its duly authorized Assistant City Manager, and and Enercon Services, Inc., an Oklahoma corporation ("Contractor"), acting through Peter J. Capponi, its duly authorized Vice President. City and Contractor may be referred to herein individually as a Party, or collectively as the Parties. WHEREAS, the City and Enercon Services, Inc. have entered into that certain agreement identified as City Secretary Contract No. 47954 (also the "Contract") commencing on July 8, 2015 for professional services for environmental and engineering consulting projects during the term of the agreement as authorized by Mayor and Council Communication C-27811; and WHEREAS, municipal contracts for services are exempt from the provisions of Chapter 252 of the Texas Local Government Code under the General Exemption provided for procurements necessary to preserve or protect the public health or safety of a municipality's residents; and WHEREAS, that contract was for an initial term of one year and that contract provides for the extension of the term of the agreement for up to four additional periods of one year each; and WHEREAS, the parties wish to extend the term of the initial contract for an additional year commencing on July 12, 2017 through July 11, 2018, and sufficient funds have been appropriated; and WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the same as stated in City Secretary Contract No. 47954; NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, the parties hereto agree as follows: 1. Extended term of contract: City Secretary Contract number 47954 is extended to include the term beginning on July 12, 2017 and ending on July 11, 2018. Compensation Not to Exceed Amount: Compensation shall not exceed four hundred thousand dollars ($400,000.00) for the term of this amendment, billable according to the fee schedule and subject to all other terms and conditions as stated in City Secretary Contract number 47954, and subject to prior duly authorized and executed amendments. 3. Miscellaneous: All other definitions, terms, and conditions of City Secretary Contract number 47954 shall remain unchanged except as expressly set forth herein. DISCUSSION: This Professional Services contract provides on-call, professional environmental and engineering resources to enhance existing Staff regarding state and federal environmental compliance including the Clean Air Act (CAA), Clean Water Act (CWA), Resource Conservation and Recovery Act (RCRA), Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), hazardous waste issues, the City's petroleum storage tank management program, environmental due diligence studies and other environmental projects. Contract services also provide specialized services when required to ensure projects meet stringent regulatory requirements. A Request for Qualifications (RFQ) was advertised on January 18, 2016. Responses were submitted by the following 13 firms on February 18, 2016: Responsive Submittals 1. AECOM Technical Services, Inc. 2. Enercon Services, Inc. 3. ECS Texas, LP 4. GHD Services, Inc. 5. Kleinfelder, Inc. 6. Legette, Brashears, and Graham, Inc. 7. Pape-Dawson Engineers, Inc. 8. Professional Service Industries, Inc. 9. Terracon Consultants, Inc. 10. Tolunay-Wong Engineers, Inc. 11. TRC Environmental Corp. 12. Vertex Companies, Inc. 13. Weston Solutions, Inc. The submittals from each of the 13 firms were reviewed and rated, by committee, based on the published weighted selection criteria. Enercon Services, Inc., was selected as the most highly qualified provider, based on demonstrated competence and qualifications provided in Statement of Qualifications (SOQ) to perform the services in accordance with Chapter 2254 of the Texas Government Code. RENEWAL OPTIONS - This contract may be renewed for up to four successive one-year terms at the City's option. Renewal may be effected by notice in writing by the City Manager, or his designee, to the contractor within 30 days of the expiration of the prior term. M/WBE OFFICE: Enercon Services, Inc., is in compliance with the City's BDE Ordinance by committing to 15 percent SBE (Small Business Enterprise) participation. The City's SBE goal on this project is 15 percent. This contract serves the entire city in ALL COUNCIL DISTRICTS. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds will be available in the current operating budget, as appropriated, of the Environmental Management Project Fund. The department anticipates spending $200,000.00 in Fiscal Year 2016 and funds are available within the existing appropriations for these expenditures. Prior to an expenditure being made, the department has the responsibility to validate the availability of funds.
