,i FIRST AMENDMENT TO
FORT WORTH CITY SECRETARY CONTRACT NO. 45868
This Amendment is made between the City of Fort Worth ("City"), a municipal corporation,
acting herein by and through Fernando Costa, its duly authorized Assistant City Manager and
Eliseo Garcia("Artist").
WHEREAS, City and Artist entered into an Agreement identified as Fort Worth City
Secretary Contract No. 45868 ("Agreement") for professional services assisting the City's public
art program; and
WHEREAS, it is the collective desire of both City and Artist to revise the compensation
schedule contained in the Agreement in order to compensate for consultation services provided
to date;
NOW THEREFORE,KNOWN ALL BY THESE PRESENT:
Fort Worth City Secretary Contract No. 45868 is hereby amended to be effective on April 28,
2017 by:
1. Replacing Article 3 of the Agreement in its entirety to read as follows:
3.1 COMPENSATION.
Total compensation to Artist under the Agreement shall be ONE THOUSAND, FIVE
HUNDRED DOLLARS AND NO CENTS ($1,500.00) which shall constitute full compensation
for any and all costs associated with the Agreement, including, but not limited to, all travel
expenses, and services performed and materials furnished by Artist under this Agreement. Artist
and City may amend this Agreement to allow for additional payment if additional services are
required.
a. Artist will bill City a rate of$100.00 per hour for only the actual hours worked and only
up to fifteen (15) hours. If Artist exceeds fifteen (15) hours, Artist will only be paid for
the additional hours if agreed to in writing by City.
b. Artist may invoice City up to an amount of ONE THOUSAND, ONE HUNDRED AND
TWENTY-FIVE DOLLARS ($1,125.00) for services rendered in advance of presentation
of the final Site Design.
c. Within thirty(30) calendar days following the approval of the Site Design by the FWAC,
Artist will submit and City shall pay Artist for any remaining compensation due Artist,
which total paid shall not exceed the total compensation amount of $1,500.00
Compensation under this section if full consideration for design consultation services
under this agreement.

2. All other terms, provisions, conditions, covenants and recitals of said Agreement
not expressly amended herein shall remain in full force and effect.
