Vq Z-' 21 CITY OF FORT WORTH FIRST RENEWAL OF AGREEMENT WHEREAS, this FIRST RENEWAL AGREEMENT is between the City of Fort Worth, ("CITY"), and Shield Engineering Group,PLLC ("CONSULTANT"),which renews the ORIGINAL AGREEMENT (City Secretary#47525, M&C C-27617), said RENEWAL being authorized by M&C C-28200,May 2, 2017,for the PROJECT generally described as: Staff Extension Services in Managing Transportation and Public Works and Water Department Capital Projects; and WHEREAS, Staff has determined it is necessary to renew the ORIGINAL AGREEMENT and that sufficient funds have been appropriated; NOW, THEREFORE, it is agreed by the CITY and CONSULTANT as follows: Article I The Scope of Services as set forth in the ORIGINAL AGREEMENT has not changed except as modified by CONSULTANT'S proposal dated March 30, 2017 attached hereto and incorporated herein. Article H The CONSULTANT's compensation for this RENEWAL shall be an amount not to exceed $337,220, which staff deems fair and reasonable for the renewal and additional scope of services. Tasks for this project would include but not be limited to: management of the design team, coordination of franchise utilities, easements, and public meetings, and managing schedules, bidding process, and construction through the close out of the project. • Provide project management services to assist with the TRVA stormwater projects. The effort is anticipated to be approximately 4-7 hours per week. The estimated hourly effort for a Project Manager Home Office Rate is $55,520. DISCUSSION: On February 9, 2016, (M&C C-27617) the City Council approved a Professional Services Agreement with Shield Engineering Group, PLLC (Shield), in an amount not to exceed $291,200.00 for staff extension services in managing Transportation and Public Works (TPW) Capital Projects. The contract allowed for additional renewal periods, contingent upon City Council approval. This Mayor and Council Communication (M&C) will authorize renewal for approximately 12 months for project management services on 10-12 projects. Shield proposes to provide these services in an amount not to exceed $337,220.00. Sewer Capital Projects Fund Legacy and 2007 Critical Capital Budget funds will be used for a project with associated sewer and street improvements. M/WBE Office -A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department and approved by the M/WBE office, in accordance with the BDE Ordinance, because the purchase of goods or services from source(s) where subcontracting or supplier opportunities are negligible. The project is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Fund Legacy. The Fiscal Year 2017 Water Operating Budget includes appropriations of $31,636,073.00 for the purpose of providing pay-as-you-go funding for sewer capital projects.
