(M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and GSWW, Inc. , (Engineer) made and entered into City Secretary Contract No. 32129, (the Contract) which was authorized by the City Council by M&C C-20821 on the 28th day of June, 2005 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Water and Sanitary Sewer Rehabilitation Contract 2004, STM-H. WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-24112, adopted by the City Council on the 2nd day of March, 2010, and further amplified in a proposal letter dated August 24, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $21, 601 . 00 . 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $142,816.00 . 3 . Authorize the transfer of$21,601.00 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of$10,800.50 and Sewer Capital Projects Fund in the amount of $10,800.50; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$10,800.50 and the Sewer Capital Projects Fund in the amount of$10,800.50, from available funds; and 3. Authorize the City Manager to execute Amendment No. 2 in the amount of$21,601.00 to City Secretary Contract No. 32129 with GSWW, Inc., for Water and Sanitary Sewer Replacement Contract 2004, STM-H, thereby increasing the contract amount to $142,816.00. )ISCUSSION: On June 28, 2005, (M&C C-20821) the City Council authorized the City Manager to execute an engineering agreement with GSWW, Inc., in the amount of$102,340.00 for Water and Sanitary Sewer Replacement Contract 2004, STM-H. The Agreement was subsequently revised by one previous Amendment, administratively approved by the City Manager on September 19, 2006, in the amount of$18,875.00 that provided for additional permanent and temporary easement preparation on the project. Amendment No. 2 will provide for the following in order to advertise the project bid: 1. Revisions to the plans and specifications to reflect current City standards; 2. Revisions to the storm water pollution prevention plans; 3. Additional plan reproduction; and 4. Field verification of current site conditions. GSWW, Inc., proposes to perform the additional services for a lump sum fee of$21,610.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. Additional M/WBE participation is not required on this amendment since the cost of the additional services to be provided is less than $50,000.00. I have provided a detailed breakdown of the hours by task as you requested. I also shuffled personnel to try to come up with a more cost efficient proposal for you. Justification Work on the original engineering contract was suspended by the City of Fort Worth in the middle of 2006. GSWW was asked to resume work and complete the contract. It is my understanding that the project was about 95% complete and only the City's final review was remaining to be completed at the time the project was suspended. Our proposed Scope of Work is as follows: We will resurrect the project and bring the plans and specifications to current City standards. The construction cost estimates will be updated. Ownership of adjacent properties will be researched and updated on the plans. The construction documents will be updated to new City requirements. Site visits will be performed at all 12 locations to visually verify site conditions. No additional field survey is expected or requested. Should design changes be needed due to changes in observed field conditions, those changes will be by separate Amendment. The SWPPP will be reviewed and modified to incorporate new standards. This scope of work assumes that no new geotechnical engineering will be performed - the previous pavement recommendations from City of Fort Worth will be utilized.
