AMENDMENT No. 4 cONTRACT NO.
TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and GSWW, Inc. , made and
entered into City Secretary Contract No. 32129, (CONTRACT) which was
authorized by M&C C-20821 on the 28th day of June, 2005 in the amount
of $102,340. 00; and
WHEREAS, GSWW, Inc. was subsequently acquired by and merged into
Burgess & Niple, Inc. (collectively and hereafter, ENGINEER) ; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment
Number 1 in the amount of $18, 875 . 00 which was authorized
administratively on September 19, 2006, Amendment Number 2 in the
amount of $21, 601. 00 which was authorized by M&C No. C-24112 on March
24, 2010 and Amendment No. 3 in the amount of $8, 863 . 00 which was
authorized administratively on August 8, 2012; and
WHEREAS, the CONTRACT involves engineering services for
the following project:
Water and Sanitary Sewer Replacement Contract 2004, STM-H;
and
WHEREAS, it has become necessary to execute Amendment No.
4 to the CONTRACT to include an increased scope of work and revised
fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated August
26, 2013, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer totals $5,780 . 00 .

Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that
the total fee paid by the City for all work and services
shall be an amount of $157, 459 . 00
3 .
All other provisions of the Contract, which are not
expressly amended herein, shall remain in full force and
effect .

Mr. Chaubey:
This letter is our formal request for Supplemental Authorization to be compensated for additional
engineering services as requested by the City. Note that the original design contract was between GSWW,
Inc. and the City of Fort Worth. Since then, GSWW was purchased by Burgess & Niple. We operate as
Burgess & Niple. GSWW does not exist anymore.
Justification
City forces found an old, private sanitary sewer line draining the residence at 2917 Alton Road. This sewer
crosses 2913 Alton Road to get to the manhole at STA 3+60 of Sanitary Sewer L-2406. The private
sanitary sewer is damaged and needs to be replaced. As well, it needs to be a public sewer, requiring it to
be contained within a sanitary sewer easement. This amendment will incorporate the extra engineering
and surveying effort required for the additional work.
Our proposed Scope of Work is as follows:
We will have the existing sewer and the proposed alignment surveyed and we will provide a sanitary sewer
easement on 2917 Alton Road. Note that the needed sanitary sewer easement on 2913 Alton Road is
already being prepared under Supplemental Authorization #3. We will provide a single plan & profile sheet
of this design. After construction, we will provide a mylar record drawing. This construction work will be
performed by City forces. The City will expose the existing utility lines so that the Surveyor can locate them
and so we can design the replacement sewer line. We will not be responsible for obtaining Rights of Entry
from these property owners.
Based upon this scope of work, the additional design cost proposed for Amendment No. 4 is $5,780.00.
