In the evens of an emergency or computer application error, Performing Agency may temporarily suspend servioes withm advance notice. REiCE[MG AGENCY will seatt•'b FFRFMORMING AGENCY data bases,locate data,sad issue Certifications of Vital Records to authorized individuals reques ting such data. The certifications will be in a format formally approved by PRMRMING AGENCY. No limit will be established on the number of searches per month not resulting in is astanm of a oertiifica ion,provided the munber is reasonable. RBCMVING AGENCY will acquire the necessary data processing equipment,oommunicatious,hardware or software, and pumbase"hack rote"paper,as specified by the PWORMWG AGENCY. PERFORMING AGENCY will assist in connection of the equipment,furnish software program and provide teclutaded assistance,if necessary. RBCE MNG AGENCY acknowledges that records may not be located in the searching process iastduWd by RECEIVING AGENCY or records which are located may have errors due to: A) normal 1®y-entry errors ion spellioge; B) accidental failure on the part of th ,PBRFOR)AING AGENCY to update a file for an amendment or paternity determination;and C) the event year does mot exist on the system. RECEIVING AGENCY is to maintain ren inventory control and account for each document produced on "bank note' paper,including voided documents. RECEIVING AGENCY is responsible for maintaining a system of vital record 1weping that is in accordance with Chapwn 191 through 195 of the Health and Safety Code aid the mgulatians adopted thereunder. A monthly itemized billing slowing the number of tnntactwns by date will be apbmitted to RECEIVING AGENCY by PERFORMING AGENCY and payment will be made no later than thirty(30)days following the billing date. Payment will be considered made on the date postinuimd. MV CONInDENTIALITY RECEIVING AGENCY will maituain sufficient safeguards to prevent release or disclosure of any information obtained h,amnader to anyone other than RECEIVING AGENCY employees) or those who have an official need for the information and are authorized to receive such records. I/L TERMINATION This contract may be tetminakd either by nn"agreement of the parties or by either party upon the saving of sixty(60) days written notice to the other party. RECEIVING AGENCY agrees to pay PERFORMING AGENCY for all services completed prior to tho offectivo date of such terraination. Performing Agency may immediately suspend this agreement upon reasonable suspicion that terms of this agreement have beaux violated by the Receiviog Agency or one of its eunplayew. If,abhor investigation it is ooaclded that a violation of this agreement has occurred,Performing Agency may terminate this agreement without further notice. Vim. FUNDWG This centrad is contingent upon the availability of funding. RECEIVING AGENCY will have in right of action against the State of Texas or the PERFORMIIdG AGENCY in the event that PERFORMING AGENCY is tenable to fulfill its obligations under this contract as a result of the suspension, termination, withdrawal, or failure of funding to PERFORMING AGENCY or lack of sufficient funding of PERFORMING AGENCY for any Adacac•.hment(s)to this contract. DISCUSSION: On June 4, 1991, the City Council approved M&C C-12899 accepting and executing a contract with TDH to access the on-line database for birth certificates for births recorded outside the city limits of Fort Worth. In FY96-97 38,107 birth certificates were sold: 6,522 from the TDH on-line system and 31,585 from City of Fort Worth records, generating revenue totaling $495,392. The Vital Statistics section also generates revenue from the sale of Birthcards& Death certificates. The sections total estimated revenue budget is $593,994. On August 6, 1997, the Bureau of Vital Statistics notified the Vital Statistics Office that a new system would be implemented for accessing birth certificates from the on-line system. A new contract and new procedures are required to implement the system. The requirements for accessing the on-line system are listed below: 1.Continue to use bank note paper for certificates printed from the Texas Department of Health database. 2.Continue to rebate $1.83 per vital record to the Texas Department of Health for each vital record produced from the on-line system. 3.Purchase bank note paper for birth cards(cards previously were issued on non-certified paper). 4.Install InterNet. The Vital Statistics office will continue to use in-house microfilm retrieval for births recorded in the city limits of Fort Worth. The existing contract will be terminated effective October 15, 1997. The new contract period begins October 1, 1997. In 1991 the change to bank note paper for birth certificates was instituted. Bank note paper is also now required to access the on-line system to issue birth cards. A two year supply of Bank Note paper for birth cards will cost approximately $1500 and other associated costs will be about $600. The total cost of$2100 can be absorbed in the existing Public Health Department budget. This expenditure will be offset by an estimated$9,797 in revenue to the General Fund from sale of birth cards.
