§ EASEMENT MODIFICATION AGREEMENT
COUNTY OF TARRANT §
For and in consideration of Ten and No/100 Dollars ($10.00), and other good and
valuable consideration, receipt of which is acknowledged by City of Fort Worth, a municipal
corporation, Grantor, the Easement and Right-of-Way dated June 7, 1950, recorded in Volume
2205, Page 95 of the Deed Records of Tarrant County, Texas, as modified by that certain
Modification of Easement dated September 10, 1973, and further modified by that certain
Modification of Easement dated April 14, 1975, (as modified, the "Easement and Right-of-
Way") is hereby further modified to grant to Oncor Electric Delivery Company LLC, 1616
Woodall Rodgers Freeway, Dallas, Texas 75202, successor to Texas Electric Service Company,
Grantee, the right to remove the electric transmission line currently existing on the property
described in the Easement and Right-of-Way and to erect, construct, reconstruct, inspect, repair,
maintain, improve, operate, and remove an electric transmission line, with all necessary
appurtenances, including multiple circuits and steel or concrete monopoles as supporting
structures, on the property described in the Easement and Right-of-Way (both Tract Nos. 1 and
2).
The Easement and Right-of-Way is hereby further modified to provide that Grantee's
right to trim or cut down trees or shrubbery shall be limited to the 50 foot easement area
described in the Easement and Right-of-Way; provided, however, that Grantee shall have the
right to trim and cut down trees and shrubbery outside of said easement area to the extent
Grantee determines, in its reasonable judgment, that such tree or shrubbery poses a hazard to
Grantee's electric facilities provided Grantee gives Grantor notice of such trimming or removal
of trees outside of the easement area immediately upon completion.
All other rights granted in the Easement and Right-of-Way which are not in conflict with
the terms of this Easement Modification Agreement continue in full force and effect.
TO HAVE AND TO HOLD the above described modified easement and right-of-way
unto the said Grantee, its successors and assigns, until all of Grantee's lines and other facilities
shall be abandoned, and in that event said easement and right-of-way shall cease and all rights
herein granted shall terminate and revert to Grantor or Grantor's heirs, successors or assigns; and
Grantor hereby binds Grantor and Grantor's heirs, successors, assigns, and legal representatives,
to warrant and forever defend the above described easement and right-of-way unto Grantee, its
successors and assigns, against every person whomsoever lawfully claiming or to claim the same
or any part thereof.
