Louis Construction of Texas, Ltd., for Thirty-Six Inch Water Main Extension Along Trinity Railway Express Right-of-Way from Tarrant Main Street to the State Highway 360/Trinity Boulevard Intersection (COUNCIL DISTRICT 5) RECOMMENDATION: It is recommended that the City Council authorize the execution of Change Order No. 3 to City Secretary Contract No. 38708 with S.J. Louis Construction of Texas, Ltd., in the amount of $382,195.90 for a thirty-six inch water main extension along the Trinity Railway Express right-of-way from Tarrant Main Street to the State Highway 360/Trinity Boulevard Intersection, thereby, increasing the contract amount to $3,738,370.90. DISCUSSION: On January 13, 2009, (M&C C-23278)the City Council authorized the execution of a contract in the amount of$3,209,344.50 with S.J. Louis Construction, of Texas, Ltd., for a 36-inch water main extension along the Trinity Railway Express right-of-way from Tarrant Main Street to the State Highway 360/Trinity Boulevard Intersection (TRE Water Main). The contract was subsequently revised by two change orders in the amount of$146,830.50 (Change Order No. 1: $40,100.50; M&C C-23949, December 8, 2009 and Change Order No. 2: $106,730.00; M&C C-24350, July 20, 2010). During construction of the TRE Water Main, it was determined that the entity from whom the City had acquired an easement to construct a portion of the water main was a lessee and not the legal owner of the land. Consequently, work was suspended pending resolution of the matter. Subsequent protracted easement negotiations with the actual owner ultimately necessitated redesign of portions of the project. Change Order No. 3 will provide for the increased and additional pay item quantities that are necessary due to the redesigned scope consisting of revised pipe grade and elevation, increased material and labor costs and revisions to the proposed meter station piping valves and electrical work. M/WBE Office- S.J. Louis Construction of Texas, Ltd., agrees to maintain its initial M/WBE commitment of 14 percent that it made on the original contract and extend and maintain that same M/WBE commitment of 14 percent to all prior change orders up to and inclusive of this Change Order No. 3. Therefore, S.J. Louis Construction of Texas, Ltd., remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This adjustment is based on using 24" DIP spool pieces in the meter vault and adjacent butterfly vault. In our discussions you asked for some additional information that summarizes the changes and reasoning for the additional costs included in this CMR. Let us start by pointing out that there are numerous,significant changes to the Meter Station work. First of all,between additional 24"gate valves and a 24"check valve,this accounts for about $87,000.00. Another major item is the additional 24"yard piping that was added. There is now over 500 LF of additional 24" B303 pipe that is loaded with specials and fittings. This accounts for about$162,000.00. We have provided you with backup from Hanson which shows the significant cost associated with these materials. Given all of the fittings,etc.,there is a major installation and welding costs associated with all of this work. About$47,000.00 is associated with the increase in pipe diameter for the meter vault and adjacent butterfly vault. There is$8,000.00 of additional electrical work. A few other major items include the additional 36" butterfly valve&vault at$47,000.00. There were five (5) in the original contract and now there are six(6). We should take this opportunity to point out that in our meeting weeks ago, SJL agreed to provide you with the large butterfly valve vaults like the ones used on Eastside. After receiving pricing from our subcontractor,Guzman Construction,we have realized this will cost us a significant amount of money. SJL will hold up our agreement to do this. There is also a new 2"ARV @ $16,000.00 and we have included only$30,000.00 for additional labor,equipment,and fuel costs associated with plan changes including the alignment,grade,and existing pipe removal. SJL has provided the included pricing in good faith to make sure this project moves forward. We hope the above information helps provide a snapshot of the changes. Please note that the pricing included has been reduced significantly from our previous proposals and this was done given our valued relationship with the City of Ft.Worth.
