(ENGINEER) made and entered into City Secretary Contract No. 47117, (the CONTRACT) which was authorized by M&C C-27488 on the 29th day of September, 2015 in the amount of $449,945.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Upper Big Fossil Creek Drainage Basin Parallel Interceptor Improvements; and WHEREAS, it has become necessary to execute Amendment No.1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated July 14, 2017, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $9,355.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $459,300. 00 . 3. City of Fort Worth Water Department 311 W Tenth Street Fort Worth, Texas 76102 Re: Fee Proposal for Contract Amendment No. 1 — Upper Big Fossil Creek Drainage Basin Interceptor Improvements City of Fort Worth Project No. 02515 (TNP Project No. FTW 14342) Dear Mr. Norwood: Teague Nall and Perkins, Inc. is submitting this fee Amendment for the above referenced contract based on additional services required.The following is a brief description and cost for the additional services to be provided on this project: I. SUE Services TNP proposes to provide quality level 'A' Subsurface Utility Engineering (SUE)performed in accordance with CI/ASCE 38-02 for the existing utility lines described below and shown on the attached location exhibit: 1. 36"Water Line(City of Fort Worth)—based on available record drawings,X-9214, the water line located just west of Beach Street will be within a few feet vertically of the proposed sanitary sewer.Obtaining exact vertical location through a Level A test hole will confirm sufficient separation. 2. 4.5"Gas Line(Barnett Gathering)—no record drawings are available for this line that is located near the sixth hole of Fossil Creek Golf Club.Obtaining a Level A test hole will be necessary to verify there is no conflicts with the proposed sewer line. 3. Fiber Optic Duct Bank (AT&T and Zayo) — based on electronic depth readings taken while performing SUE Level B locating,the depth of the duct bank located just east of Riverside Drive increases as it approaches Fossil Creek. The readings indicate a possible conflict with the proposed sewer line. A level A test hole at the proposed crossing will verify if sufficient vertical separation exists. Locating these lines will help minimize conflicts between the proposed sewer line and existing utility lines it is in close proximity to.The scope of services necessary to locate these lines is given below. A. Level 'A' SUE Investigation The following effort will be required: 4. Coordinate with utility owner inspectors as may be required by law or utility owner policy. 5. Neatly cut and remove existing pavement material, such that the cut does not exceed 0.10 square meters(1.076 square feet)unless unusual circumstances exist. Measure and record the following data on an appropriately formatted test hole data sheet that has been sealed and dated by the Engineer: a. Elevation of top and/or bottom of utility tied to the datum of the furnished plan. b. Identify a minimum of two benchmarks utilized.Elevations shall be within an accuracy of 15mm (.591 inches)of utilized benchmarks. c. Elevation of existing grade over utility at test hole location. d. Horizontal location referenced to project coordinate datum. e. Outside diameter of pipe or width of duct banks and configuration of non- encased multi-conduit systems f. Utility facility material(s). g. Utility facility condition. h. Pavement thickness and type L Coating/Wrapping information and condition. j. Unusual circumstances or field conditions. 7. Excavate test holes in such a manner as to prevent any damage to wrappings, coatings, cathodic protection or other protective coverings and features. Water excavation can only be utilized with written approval from the City. 8. Be responsible for any damage to the utility during the locating process. In the event of damage,the Engineer shall stop work, notify the appropriate utility facility owner, the City and appropriate regulatory agencies. The regulatory agencies include, but are not limited to the Railroad Commission of Texas and the Texas Commission on Environmental Quality. The Engineer shall not resume work until the utility facility owner has determined the corrective action to be taken. 9. Back fill all excavations with appropriate material, compact backfill by mechanical means, and restore pavement and surface material. The Engineer shall be responsible for the integrity of the backfill and surface restoration for a period of three years. Install a marker ribbon throughout the backfill. 10. Furnish and install a permanent above ground marker directly above center line of the utility facility. 11. Provide complete restoration of work site and landscape to equal or better condition than before excavation. If a work site and landscape is not appropriately restored, the Engineer shall return to correct the condition at no extra charge to the City. B.Deliverables: 1. The Engineer shall provide the following: a. A weekly summary of work completed and in process with adequate detail to verify compliance with the agreed work schedule. b. Two (2) signed and sealed sets of 8.5" x 11" colored drawings that documents QL-A data for each exposed utility. Fee Proposal for Contract Amendment No. 1: $9,355 TNP proposes a fixed fee of$9,355 to accomplish the scope of services described above. MNVBE Utilization: Due to the limited scope of this amendment, TNP commits 0% of the work covered under this amendment to a certified M/WBE firm. With this amendment,the overall M/WBE commitment will now be 12.6%, above the City's M/WBE goal of 10%. (City Project No. 02515) DISCUSSION: On September 29, 2015, Mayor and Council Communication (M&C C-27488) the City Council authorized an engineering agreement with Teague, Nall and Perkins, Inc., in the amount of$449,945.00 for Upper Big Fossil Creek Drainage Basin Parallel Interceptor. This Agreement requires additional funding for project management, real property acquisitions and to cover costs associated with Amendment No. 1, in the amount of$9,355.00, that provides subsurface utility engineering services on the project. In addition to the amendment amount, $205,000.00 is required for project management and real property acquisitions. This project will have no impact on the Water Department's operating budget when completed. Design is expected to be completed by March 2018. Construction is expected to start on August 2018 and be completed by May 2019. The total cost for the Upper Big Fossil Creek Drainage Basin Parallel Interceptor Improvements is estimated to be$2,910,000.00. The project is located in COUNCIL DISTRICT 4. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water Capital Projects Fund. The Fiscal Year 2017 Sewer Operating Budget includes appropriations of$31,636,073.00 for the purpose of providing Pay-As-You-Go Funding for Capital Projects.After this transfer for Fiscal Year 2017, the balance will be $3,870,024.00.
