WHEREAS, The City of Fort Worth and HKS, Inc. (Consultant) made and entered into
City Secretary Contract No. (The Contract) which was authorized by the City Council by
M&C C-28294, the 20th day of June, 2017, to provide architectural design and
construction administration services for the New Como Community Center located at
Chamberlin Park and;
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services for additional MEP conceptual design services, see Attachment "F".
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:
1.
Article 1 — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional MEP design services for the design and detailing of
additional concepts. The cost of this additional service is $33,000.00 plus $0.00
in reimbursable expenses. The scope of services is described more fully in HKS,
Inc.'s Letters dated September 5, 2017 labeled Attachment"F".
2.
Article II —Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "A". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "A". However the total fee paid by the City shall not
exceed a total of $884,511.74 unless the City and the Consultant mutually agree
upon a fee amount for additional services and amend this Agreement
accordingly."
3.
All other provisions of this Contract which are not expressly amended herein shall
remain in full force and effect.

Revision to Mechanical,Electrical,Plumbing Fee

Dear Ms.Alanis:
HKS,Inc.,("HI(S")is requesting a revised fee for the Mechanical, Electrical,Plumbing Engineer for the
Como Community Center project.
The Engineer provided two fees to HI(S. One fee for the Community Center and another fee for
future Athletic Building. However, in their proposal to HKS,the Engineer reversed the fees and it was
not discovered until the A/E Agreement was written.
In the original HKS proposal to the City,the MEP fee was listed as$71,000.00.The correct fee is
$104,000.00.Therefore, HKS requests the additional fee of$33,000.00 to correct the MEP fee.
We apologize for the error and appreciate your attention to the matter.
