THIS FIRST AMENDMENT to City Secretary Contract No. 48168 is entered into by an
between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas,
acting through Fernando Costa, its duly authorized Assistant City Manager, and
Kleinfelder, Inc., a Texas corporation, ("Contractor"), acting through David R. Boes,
P.G., its duly authorized Vice-President, Area Manager.
WHEREAS, the City and Kleinfelder, Inc have entered into that certain agreement
identified as City Secretary Contract No. 48168 (also the "Contract") commencing on
September 19, 2016 for professional petroleum storage tank (PST) construction
management and technical guidance services associated with the removal of existing
underground storage tanks and the installation of replacement aboveground storage tanks
and associated fuel management and delivery equipment as authorized by Mayor and
Council Communication C-27902; and
WHEREAS, municipal contracts for services are exempt from the provisions of Chapter
252 of the Texas Local Government Code under the General Exemption provided for
procurements necessary to preserve or protect the public health or safety of a
municipality's residents; and
WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the
same as stated in City Secretary Contract No. 48168 (Contract);
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:
1. Additional Scope of Sevices to be Provided:
City Secretary Contract No. 48168 is amended to include within the scope of services the
provision to provide professional petroleum storage tank (PST) construction management
and technical guidance services associated with the removal of existing underground
storage tanks and the installation of replacement aboveground storage tanks and
associated fuel management and delivery equipment. All PST construction management
and technical guidance services shall be in conformance with all applicable federal, state,
and local laws and using best engineering, safety, record-keeping, and management
practices applicable.

2. Compensation Not to Exceed Amount:
Contractor acknowledges and agrees that the original not exceed amount of two hundred
seventy-five thousand dollars four hundred thirty-six dollars ($275,436.00)as stated in
City Secretary Contract number 48168 shall not be increased. Contractor further agrees
that the original not to exceed amount is sufficient to compensate Contractor for the
additional scope of services in this Amendment, as well as those in the Contract.
3. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract number 48168
shall remain unchanged except as expressly set forth herein.
