TO CITY SECRETARY CONTRACT No. 42723
WHEREAS, the City of Fort Worth (CITY) and James DeOtte Engineering,
Inc. , (ENGINEER) made and entered into City Secretary Contract No. 42723,
(the CONTRACT) which was authorized by M&C C-25189 on the 11th day of
September, 2011 in the amount of $526, 623; and
WHEREAS, the CONTRACT was subsequently revised by Amendment Number 1
in the amount of $149, 866 which was authorized by M&C # C-27778 on June
21, 2016, Amendment Number 2 in the amount of $39, 300 which was
administratively authorized on and

WHEREAS, the CONTRACT involves engineering services for the
following project:
Greenfield Acres Storm Drain Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated October 19, 2017, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $35, 300. 00. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $751, 119. 00 .

GREENFIELD DRAINAGE IMPROVEMENTS

Mr. Eubanks,
Due to additional services that are outside the scope of the existing contracted
agreements that have been requested by the City to be performed as part of the
referenced project, James DeOtte Engineering, Inc.will perform the work outlined in the
following items:
Additional services:
1. Re-design of a detention pond in lieu of a drainage channel on City acquired
property on the south side of South Ridge Road.
Available funding has presented an option to increase the volume of the current
drainage channel into a detention pond. The detention pond will be bound by the
City acquired properties. The top of slope being generally offset -10' from the
bordering property lines except around the re-routed sewer line along the south &
west edges and the preserved trees at the northeast corner of the pond area. Slopes
will be 4:1 on all sides except for the area west of the incoming box culverts at the
northwest corner of the pond area. The regraded volume will be based on doubling
the original construction excavation volume to create approximately an additional
32,000 cubic yards of excavation. This scope item also includes one review revision
iteration after the initial update. All subsequent revision iterations that the City should
wish to be performed shall be considered additional services not included in this
amendment and will not be performed without agreement of another design fee
amendment.

Greenfield Drainage Improvements
Amendment No. 3
2. Floodplain model update to include new detention pond in lieu of drainage channel
for LOMR submittal. The scope for this item will include updating the hydraulic &
hydrologic models occurring only upstream of downstream connection of the
channel into the existing twin 5'x4' box culverts north of Fathom Drive using the
currently proposed closed storm drainage system's figures. This scope item also
includes one review revision iteration after the initial update. All subsequent revision
iterations that the City should wish to be performed shall be considered additional
services not included in this amendment and will not be performed without
agreement of another design fee amendment.
JDEI anticipates the fees listed above for the various elements of the project to be a not
to exceed amount of$35,300.00. All costs, associated with the identified scope of work,
will be lump sum for the scope provided and will be billed as a percentage of
completed work as determined by JDEI.
This scope of work assumes any services not specifically listed as part of this contract will
be treated as an additional service. The owner will be notified before any additional
services are performed.
