A� AMENDMENT No.1 CONTRACT NO.
TO CITY SECRETARY CONTRACT No. 42236
WHEREAS, the City of Fort Worth (CITY) and DeOtte, Inc, (ENGINEER)
made and entered into City Secretary Contract No. 42236, (the CONTRACT)
which was authorized by M&C C-25111 on the 23rd day of August, 2011 in
the amount of $ 424, 713; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Lower Como Erosion Control Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated November 2, 2017, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $26, 910. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $451, 623.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Dear Mr. Eubanks,
This memorandum is in reference to a contract between DeOtte, Inc. and the City of Fort
Worth(the City)dated August 23, 2011 herein referred to as the"Contract."
Our services during construction of this project exceeded the allotted time for those due to the
sensitive nature of the construction. The previous memorandum of understanding from
November 2015 had reduced the scope and fee for work under the contract but a portion of the
additional construction phase work was allowed to be covered by those previous savings.As of
the September 29 billing for the original contract,there is$1,500 remaining to be billed.
Additional design services have been requested for new construction in the same creek beyond
the limits of the original construction. This work will be completed under the original City
construction contract as a change order. Amendment No. 1 is offered to cover the scope and fee
of additional design work for this additional construction.
Also, the remainder of the additional construction phase related assistance beyond the original
contract is included in this amendment as well.
The attached Level of Effort Spreadsheet includes the work for both the additional construction
phase related work as well as the additional design work requested by the City. We anticipate
that the amendment amount will be sufficient to complete all work in both the original design
contract and the additional work needed in the creek.
