ADDENDUM TO R4 RENEWAL SERVICE ORDER NO.22298-36-02
BETWEEN
THE CITY OF FORT WORTH
AND
LEVEL 3 COMMUNICATIONS,LLC
This Addendum ("Addendum") (i) is entered into by and between LEVEL 3 COMMUNICATIONS,
LLC ("Level 3")and the City of Fort Worth("Customer"), and(ii)modifies R4 Renewal Service Order—
Contract ID 22298-36-02 signed by Customer (the "Service Order"), a copy of which is attached and
incorporated by reference. This Addendum is effective as of the date executed by both parties.
WHEREAS, the parties wish to augment the Service Order to clarify the terms and conditions that
govern the order.
NOW THEREFORE,the parties agree to modify the Service Order in the following limited respects:
1. GSA Schedule 70 Contract. Except as indicated below, notwithstanding anything to the contrary in
the Service Order, the parties agree that the Services are governed by the terms of Level 3's GSA
Schedule 70 Contract No. GS-35F-0426R(the"Schedule 70 Contract").
2. Open Market Items. Certain elements of the renewed Services are not available under the Schedule
70 Contract. Such elements are indicated with a double asterisk(**) in the column captioned "PIID"
on the Service Order(the"Open Market Items"). As a result,the Parties agree that the Master Service
Agreement entered into by Level 3 and Customer, effective September 19, 2011, City Secretary
Contract Number 42303 (as amended or otherwise modified to date)applies to and governs the Open
Market Items on the Service Order.
3. Limited to Relevant Service Order. The parties acknowledge and agree that this Addendum shall
apply to the Service Order and shall have no applicability to any other order(s) that Customer may
have otherwise submitted or may submit to Level 3 in the future. All other Terms and Conditions
will remain in effect.
These terms and conditions have been read,are understood, and are hereby accepted.
