COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth ("City") and Trinity Engineering Testing Corporation
(Kleinfelder), made and entered into City Secretary Contract No. 33135 authorized by City Council
via
M&C C-21196 on December 13, 2005; and
WHEREAS, the Agreement Provides Laboratory Services in Testing of Developer
Projects; and
WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to
increase the maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized
representatives, enter into the following agreement that amends the Contract:
1.
Article II, of the Contract is amended to provide for a $ 60,052.05 increase in the maximum
fee to be paid to Engineer for all work and services performed under the Contract, as amended,
so that the total fee paid by the City for all work and services shall not exceed the sum of
$260,052.05.
2.
All other provisions of the Agreement which are not expressly amended herein shall

Material Testing for Various Developer-Initiated Construction Projects
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 in the
Amount of$60,052.05, to City Secretary Contract No. 33135 with Trinity Engineering Testing Corporation
d/b/a Kleinfelder, for Geotechnical and Construction Material Testing for Various Developer-Initiated
Construction Projects thereby increasing the total contract amount to$260,052.05.
DISCUSSION:
In January 26, 2006, City Council Authorized the City Manager to execute a contract(City Secretary
Contract No. 33135)with Trinity Engineering Testing Corporation d/b/a Kleinfelder, for geotechnical and
construction materials testing for a period of one-year with two, one-year renewal options with an
aggregate fee not to exceed $200,000.00 for each agreement. The Trinity Engineering Testing
Corporation d/b/a Kleinfelder contract limits were exceeded while some projects were still under
construction. Amendment No. 1 is necessary to increase the contract limits to cover the outstanding work
and assure that materials testing continues until the projects are completed.
Trinity Engineering Testing Corporation d/b/a Kleinfelder is in compliance with the City's M/WBE
Ordinance by committing to an additional 20 percent M/WBE participation on this Amendment No.1. The
City's goal on this Amendment, change order or extra work is 20 percent.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budgets, as appropriated, of the participating Capital Improvements Funds.
