HomeMy WebLinkAboutContract 32584 CITY SECRETARY CONTRACT NO.'`� s .s AMENDMENT TO CITY SECRETARY CONTRACT NO. 32333 WHEREAS, on September 9, 2005, the City of Fort Worth("City") and Ramada Inn Midtown("Hotel") made and entered into City Secretary Contract No. 32333 (the "Agreement"); WHEREAS, the Agreement set out the terms and conditions relating to Group Rooms Bookings for certain evacuees from Hurricane Katrina as City determines to place in Hotel and provides for payment for the charges for such rooms; WHEREAS, it the mutual desire of City and Hotel to Contract; and WHEREAS, it is the mutual desire of City and Hotel to amend the Agreement. NOW, THEREFORE, City, acting by and through Joe Paniagua, its duly authorized Assistant City Manager, and Ramada Inn Midtown, acting by and through Mark Brookman, its duly authorized General Manager, do hereby agree as follows: I. Subsection d) of Article II, ROOM RATES and RELATED MATTERS, is hereby amended to be and read as follows: d) BILLING. Room charges shall be assessed for each room from the date a guest is checked into that particular room. The charges for each room will be reported by Hotel to City each week as required in Article III. Hotel shall bill City every fourteen (14) days and City shall make payment to Hotel within thirty (30) days after receipt by City of each bill. II. ARTICLE III, REPORTING REQUIREMENTS is hereby amended to be and read as follows: Hotel shall send City a Notice on each Friday of each week of the total daily room charges for the seven (7) day period preceding that Friday for each room into which a guest is checked in pursuant to this Agreement, and send a Notice daily of any damage done by any guest to Hotel's property. III. ARTICLE IV, TERM OF AGREEMENT is hereby amended to be and read as follows: ` CONTRACT AMENDMENT CSC NO.32333 Ramada Inn Midtown f�. j J li �uL4a This Agreement shall be effective from October 2, 2005 and shall continue in effect through November 25, 2005. In addition, Hotel hereby grants City the right to extend this Agreement for an additional thirty days upon written notice to Hotel by City. The following article shall be added to the Agreement ARTICLE VI ASSIGNMENT a) Hotel may not assign this Agreement without City's prior written consent. b) City may assign this Agreement to FEMA or any other state or federal agency and upon the effective date of such assignment, all City obligations hereunder shall cease except for such obligations that were incurred prior to the effective date of such assignment. W. Exhibit "A" attached to the Agreement is hereby replaced with the Exhibit "A" attached hereto. All other terms and conditions of City Secretary Contract No. 32333 not amended herein remain unaffected and in full force and effect, are binding upon the Parties, and are hereby ratified by the Parties.
