STATE OF TEXAS § COUNTY OF TARRANT § THIS Contract is made and entered into by and between the City of Fort Worth ("City"), acting by and through Joe Paniagua, its duly authorized Interim Assistant City Manager, and the United Riverside Rebuilding Corporation ("Contractor"), by and through George Hill, its duly authorized President. Contractor's business address is Riverside Community Center, 201 S. Sylvania Ave., Fort Worth, Texas 76111. WHEREAS, the City and Contractor have entered into a contract identified as City Secretary Contract No.26549 for a period beginning February 9, 2001 and ending February 8, 2003; and WHEREAS it is the mutual desire of the parties to amend said City Secretary Contract No. 26549 NOW, THEREFORE, THIS CONTRACT FURTHER WITNESSETH: That, the parties covenant and agree as follows: City Secretary Contract No. 26549, currently on file in the office of the City Secretary of Fort Worth is hereby amended to read as follows: 3. Funding City provides the Contractor with CDBG monies in an amount not to exceed a total of THREE HUNDRED FIFTEEN THOUSAND THREE HUNDRED EIGHTY-ONE dollars and 78/100 ($315,381.78) to be used as follows in the United Riverside Model Blocks area: a. Minor Home Repair Program (MHRP), in an amount not to exceed TWO HUNDRED THIRTY-FOUR THOUSAND ONE HUNDRED THIRTY-THREE dollars ($234,133) to provide minor home repair to at least 52 owner-occupied homes; and b. MHRP Program Operations, in an amount not to exceed FIFTY-NINE THOUSAND NINE HUNDRED TEN dollars and 88/100 ($59,910.88); and c. United Riverside Rebuilding Corporation (URRC) Lot Purchases, in an amount not to exceed TWENTY-ONE THOUSAND THREE HUNDRED THIRTY-SEVEN dollars and 90/100 ($21,337.90) CNN �o U � Nq YR. 4. Compensation and Method of Payment Section 4 "Compensation and Method of Payment" of City Secretary Contract No. 26549, currently on file in the office of the City Secretary of Fort Worth is hereby amended to read as follows: a. City will disburse CDBG monies in an amount up to THREE HUNDRED FIFTEEN THOUSAND THREE HUNDRED EIGHTY-ONE dollars and 78/100 ($315,381.78)to Contractor on an advance of funds basis. Coverage shall be maintained by Contractor or its subcontractors. In the event the respective subcontractors do not maintain coverage, the Contractor shall maintain the coverage on such subcontractors for each applicable subcontract. 'JFRN'llki; PEI it ���} Exhibit A "Minor Home Repair Program (MHRP)" is hereby amended to read as follows: EXHIBIT "A" MINOR HOME REPAIR PROGRAM (MHRP) PURPOSE 1. To renew a sense of community pride by enhancing the appearance of the neighborhood by making minor exterior home improvements. 2. To provide one-time grants to qualified, low to moderate income homeowners. 3. To make each home as energy efficient as possible. DESCRIPTION 1. Paint exterior of homes 2. Replace windows, exterior doors, caulking, insulation and roofs. 3. Other miscellaneous enhancements including fence repair, if visible from street, driveway repair and replacement, landscaping or other exterior enhancements deemed necessary by corporation and if the above priorities have already been addressed. COMMENCEMENT DATE January 2001 this program will commence. BOUNDARIES The boundaries for the United Riverside Minor Home Repair are • North- East 1St Street • South- East 12th Street • West- Sylvania • East- Riverside Drive FUNDING The United Riverside Rebuilding Corporation (URRC) has been appropriated Community Development Block Grant Funds to undertake a program to provide exterior minor home repair assistance to residents of the URRC boundaries. The amount appropriated is $315,381.78. �y ELIGIBILITYt ����r8°�.� �E �RD 1. Owner occupant of single family or two units. CC:r 'I��,V j� °L 2. Must have lived in their home for a minimum of.one (1) year. �o ', ,��o a 3. Must be at least 21 years of age. 4. Income cannot exceed 80% of the area median income, according to United States Department of Housing and Urban Development (HUD). 5. After MHR, homeowner must live in the home a minimum of 3 years. (Should owner fail to comply, the amount of repair assistance will be due and payable in proration within 30 days after notice from the City of Fort Worth/URRC. LOGISTICS A contract will be executed between the homeowner and URRC. Contractor needs to carry all required insurance including Worker Compensation. In the event of death, if there is no surviving spouse, the beneficiary assumes all terms of the contract. Assistance will be limited to exterior repairs up to $4500.00 for one time oniy. $25.00 application fee, refundable by check, if not approved because of ineligibility. It is not the intent to abate all code violations nor cause a property to comply with the minimum housing standards. The types of repairs to be performed will be those repairs that most urgently address the exterior need that can be addressed within the $4500.00 maximum program amount. PROCEDURE 1. Application must be made/sent to the URRC, 201 S. Sylvania, Fort Worth, Texas 76111. 2. Project Manager (P.M.) assigns case to Housing Inspector. 3. Housing Inspector reviews repairs needed at house and prepared Work Write Up. 4. Repair/Work Write Up sheet brought back to P.M. 5. P.M. negotiates with the homeowner the amount of repairs to be done. 6. List of agreed upon repairs will be developed into contract. 7. P.M. submits Repair/Work Write Up to contractors for bid. 8. P.M. awards contract. 9. Contract will be signed by: P.M., homeowner, and contractor (Contract will specify all repairs to be completed with dates of start and completion) 10.Contractor completes repairs. Housing Department conducts final inspection. 11.Contractor will be paid after passing final inspection by Housing Department. 12. 10% of all contract price will be retained for 15 days and paid to the contractor upon satisfactory completion of any corrections if any. Approve the reallocation of $40,010.88 from the City of Fort Worth (CFW) Home Improvement Program, funded with 1997 Community Development Block Grant (CDBG) funds to the following: URMB Minor Home Repair Program $22,500.00 URMB Operating Fund 9,910.88 CFW Neighborhood Park Improvements 5,000.00 CFW Street Signs 2,600.00 Total $40,010.88 2. Approve the reallocation of $21,337.90 in CFW lot purchases, funded with 1990 and 1998 CDGB funds, to the United Riverside Model Blocks (URMB) lot purchases; and 3. Authorize the City Manager to: a) Amend City Secretary Contract No. 26549 with the United Riverside Rebuilding Corporation (URRC) executed on February 9, 2001, to reflect allocation of funds for the Minor Home Repair Program, Purchase of Lots and Operating Fund; and b) Further amend this contract, as needed, to achieve project goals provided the amendment is within the scope of the project and in compliance with applicable laws and regulations; and c) Extend or renew the contract if the URRC requests an extension or renewal; and 4. Amend the City's Annual Consolidated Plans for 1990, 1997, and 1998 to reflect the changes in the use of the CDBG funds cited above. DISCUSSION: In 1998, the Riverside neighborhood received Model Blocks (MB) designation and was awarded $1.2 million (M&C G-12347 dated September 29, 1998 and M&C G-12966 dated August 29, 2000). The purpose of the MB Program is to empower neighborhoods so that they may effectively work with the City and other public and private organizations to revitalize their neighborhoods. The URMB's goals are to expand the Riverside Community Center, provide homeownership opportunities, improve owner- occupied homes, improve the Gid Hooper Park, and build the neighborhood's capacity to sustain revitalization efforts. First, there is a balance of $40,010.88 in the home improvement program, which they are requesting be reprogrammed to several activities, as described above in recommendation No. 1. The neighborhood has marketed the program and believes that all interested persons have made use of the program. Secondly, the URRC, which is the development entity for the MB, is requesting that the task of purchasing vacant lots for infill housing development be transferred from the City to the URRC. The URRC was approved by the Internal Revenue Service as a tax-exempt 501(c)3 organization in December 2000, and as a Community Housing Development Organization by the City in January 2001. There is a balance of $21,337.90 for vacant lot purchases which would be awarded to URRC through amendment to City Secretary Contract No. 26549 as mentioned in recommendation No. 3(a) above. The URMB is located in COUNCIL DISTRICT 8. The Safety and Community Development Committee endorsed approval of the recommendations above on July 10, 2001. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
