HomeMy WebLinkAboutContract 26731 CCTON RANo THE CITY OF FORT WORTH PUBLIC HEALTH DEPARTMENT MEMORANDUM OF UNDERSTANDING WHEREAS the services of a Health Authority are required for the operation of the City of Fort Worth Public Health Department; WHEREAS Dr. Brian Rogers, D.O. has agreed to serve as the City of Fort Worth's Health Authority. The City of Fort Worth in behalf of the Public Health Department, hereinafter referred to as "City" and Dr. Brian Rogers, D.O., hereinafter referred to as "Health Authority" have agreed to the following terms: 1. The Health Authority agrees to perform the duties imposed by State law under the Health and Safety Code section 121.024, attached hereto as "Exhibit A", which is hereby incorporated as a part of this Agreement as if it were set forth at length. 2. The Health Authority agrees to perform the duties designated by the City of Fort Worth for emergency personnel exposed to communicable diseases, attached hereto as "Exhibit B", which is hereby incorporated as a part of this Agreement as if it were set forth at length. 3. The Health Authority warrants that he can perform the services provided for in this agreement and that the services will be performed in the highest professional standards. 4. As compensation for services rendered under this memorandum, City shall pay Health Authority one thousand dollars ($1,000)per month. 5. The term of this agreement shall commence on or about May 15, 2001 for two years, unless sooner terminated by either party. 6. Termination of this agreement without cause may be by either party with thirty (30) days written notice. Said termination notice shall be considered to be rendered when placed in the United States Postal service for delivery to the other party. Upon termination, the parties shall be released from all obligations contained in this agreement. 7. All notices, requests, demands and other communications under this agreement which are required to be in writing shall be deemed as having been duly given on the date of service, if served personally on the party to whom notice is to be given, or on the date of mailing, if mailed to the party to whom notice is to be given, by first class mail, registered or certified,postage prepaid and properly addressed as follows: "City" Daniel B. The Health Authority shall comply with all federal, state and local laws, ordinances, rules and regulations applicable to the performance of work under this agreement. 9. This agreement shall be construed in accordance with the laws of the State of Texas. Exclusive venue for any lawsuits or action of law or in equity arising hereunder shall be in Tarrant County, Texas. City Council approved re-appointment of Health Authority in M&C G-13233 5- 15-01 City of Fort Worth, Texas 4Vayor and Council Communicaidon DATE REFERENCE NUMBER LOG NAME PAGE 5/15/01 **G-13233 50AUTHORITY 1 of 1 SUBJECT REAPPOINTMENT OF HEALTH AUTHORITY RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance reappointing Dr. Brian Rogers, D.O., as Health Authority for the City of Fort Worth. DISCUSSION: Under the Health and Safety Code, the Director of the Public Health Department, who is not a physician, must appoint a Health Authority for the jurisdiction it serves. A Health Authority is a physician whose duties include establishing, maintaining and enforcing quarantine laws in the City, reporting the presence of contagious, infectious and dangerous epidemic diseases in the City to the Texas Board of Health, and enforcement of sanitation laws, quarantine rules and vital statistic collection within the City. In this capacity, Dr. Brian Rogers has served an initial term of two years, since April 1999. He has agreed to continue to serve as the City's Health Authority for $12,000 per year. In addition to the functions already listed, Dr. Rogers' primary function as Health Authority will be to implement new protocols established by the Police, Fire, Marshal, Health and Law Departments for emergency personnel who may be exposed to a contagious disease while performing their duties. Under new protocols, Dr. Rogers or his designee will be available twenty-four hours a day, seven days a week to any emergency personnel who may be exposed to a contagious disease while performing his or her duty, to make a determination as to whether mandatory testing for a contagious disease should be initiated. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current operating budget, as appropriated of the General Fund.
